SOLELY is the key word there. You must use that with other statements. If the product desription and the reviews differ, I would look at the most current reviews as testiment to what is shipping
BECAUSE in their words,

They
ARE clearly claiming to use the reivews of such products as a marketing tool so they, by their own statements, are only posting such statements they deam correct and/or beneficial to selling their product. If a different product was shipped (in my non-legally educated opinion), they would be liable for false advertising. Once Newegg makes the statement that they moderate and post only statements they wish, Newegg claims resposibility of the reivews being an accurate discription. Kinda like here at AT when they claim to moderate and let Staples coupons stay up, they are claiming responsibility for the posting of them....hmmmm? If they don't moderate and remove posts, it's much harder to prove an active participation.
However, I do see your point, and that would be for lawyers to argue in court, but my feeling is they are claiming a product is something by posting those reviews. Stating don't trust that statment shouldn't release a company from making the statement unless they are going to state product reviews may be inaccurate. They do the opposite and say they "remove any unproven biased negative comments." Of course, there is a grey area they, and they could hide behind the fact they are posting unproven positive information, but hey, isn't that false advertising?
I wouldn't take them to court over it, so all this is kinda irrelevant due to their excellent return policy. I would argue they would be responsible for return shipping if I got a slower card.
FYI, I just received my card, and looking at it briefly I believe it is the faster memory. The memory chips are labeled ending in 33.
