First time I heard about this too, must have been sweep under the rug by McD's string pullers. He did go kinda far but they got what they deserved, glad he's free.

All I know is that in my place of business I would have pulled out my shotgun the second someone comes over the counter.

I have one of my shops in a bad area of casleton near Indianapolis. There is a sign on my door that tells people to pull off hoods and hats before entry. Every shop in the area has it too. If someone does not do this they are met with shotgun in my or my GMs hands.

Glad Indiana has laws a little more agreeable to self defense....

Nice hits with the stick....good windup, follow-through and multiple strike delivery. Too bad the pole wasn't a little heavier... I sure hope he didn't bend or damage that pole against those 2 girls' heads.

Agreed, he knocked each of them down with 1-2 blows easily, and continued to hit like 10 times after they were down

they came over the counter at his job....unless he caused some horrifying damage to them, i just dont see a problem

The guy is a piece of shit and will end up back in prison soon enough (he just got off a ten year bid for murder BTW). If a person comes over the counter with a weapon I could see resorting to that level of violence but this was two unarmed women and he kept beating them with a metal rod long after they went down. That was felony assault, period.

Hell no. He defended himself against a couple thugs. That they are unarmed females doesn't make them any less a pair of uncivilized thugs. This was self-defense, no doubt about it, and the grand jury recognized it too.

He was right to use force in self defense, and yes he might have gotten away with shooting them initially.

However, he did not shoot them, he beat them and in self defense once a threat is gone, any force beyond that is not justifiable.

He crossed the line in the legal sense. He went beyond self defense, but in cases like these(going beyond that line) rarely do DA's get a true bill unless you actually kill someone and even then its rare.

Technically it was under NY law, but unless you kill someone, its rare that DA's can get a true bill on defendants that cross the line of self defense.

But the threat wasn't gone, threat tried to come after him again and he likely assumed she had a weapon. From a legal perspective it was all perfectly fine. He has no duty to retreat. That can be seen from how the grand jury ruled, DA was unable to prove a crime occurred. Hell, in most other states it wouldn't have even gotten to a grand jury.

Once the disparity of force and jumping over the counter, he could do just about anything to them.

If you look closely, you can see they were trying to get back up. I think he might have gone a bit far too, but not in a way that was criminal. Once you're in fight or flight mode (which he was in because they struck him and then jumped over the counter), I don't think it's easy to just turn off the switch.

He out weighed them, was armed and had backup. I think after you get whacked a few times by that pole whatever the hell you were arguing about leaves your mind and you just want to get up and leave.

He's obviously a violent felon to behave like that. Ten years in prison will do it to you. The victims were gay BTW. Hate crime to boot, no doubt.

Bets are he'll be back in prison for killing someone else by this time next year.

I wish this guy was working in the mcdonalds where the tranny got the shit knocked out of her by two women instead of the employees that just stood there and laughed or took cell phone videos for you tube. Some of these spiteful bitches picking fights and starting trouble need a smackdown, if not for the sake of their victims they've attacked, then for the sake of themselves. Hopefully the instigators learned something from the experience and will think twice before attacking people.

In NY he did have a duty to retreat and your logic is flawed. The initial disparity of force isn't a free pass once they no longer represent a threat. I do think the right thing happened here. It went to a GJ and they decided not to charge him.

So violent that after getting berated, verbally abused, and then even physically attacked he remains calm and walks away. I don't know many people that would take that kind of abuse from a stranger then walk away including myself.
