I'm sick of hearing about litigation especially since every lawyer in the nation is down in my native state of FL!

Leave buy.com alone!

That's just plain silly to talk about suing them!

I would be very surprised if any old timer around here would support any thing that would harm buy.com. We depend on buy.com for giving us some of the best prices especially in conjunction with DOTD's,free shipping, and coupons!


Mispricing/incorrect product descriptions comes with the territory.

What if you knowingly ordered the crappy monitor and they sent you the 445PRO? Would you write them a check for the difference or call them to return it at your expense? What if they could sue you in that scenario!

I am continually amazed at all the comments about retailers that "suck" yet the same person is first in line for the hot deals at those sites especially when there is a pricing error in their favor!

Send it back for free, move on and find a hot deal that you can share with the rest of us.

This comment is generic and not directed at any one person.

I think that rebuilder is right on this one. It sure is tempting to sue buy.com. However we are clearly not stupid consumers here. We more or less knew what we were getting ourselves into, the price was a bit too good. I dont want to see buy.com go out of business either, and they sure are heading the way of VA.com... Remmember those $10 off no limit coupons, and free shipping during Holidays last year? Combined with webcertificates that was crazy Buy.com will lose at least $100 on the shipping of each monitor already, lets leave them alone, and let this $100 per monitor be a lesson. Take pitty. These last few months a lot of e-retailers have gone out of business. We dont want to send the wrong message to venture capitalists. I sure dont want to go back to buying computer hardware at staples and best buy B&M. Buy.com is one of the first and fairest retailers. In my personal oppinion I really wanna see buy.com and onvia.com survive, lets let them.

Nobody is saying we ARE going to sue them. I don't even care for compensation. They just have to be responsible for what the put on their site. They put a description of an item that they are selling and they better ship me that product that they advertised for. This is not even a mis priced case. I am buying a $339 REFURBISHED mon that only have 90 days warranty. This is a GAMBLE for me.

$339 to me is a lot unlike most of you. It takes me time to earn those money. I just don't want to waste more time to find out it's the wrong mon that I have to go and ship it back. Would that be fine for you for every 10 items you buy, 3 of them you have to go and do such a thing? Retailer just have to be responsible for what they display.

Conclusion: This is not a case of people taking advantage of a mispriced item, so don't treat it that way by defending the retailer first without realizing what you guys are talking about.

TOMCAT: Exactly, why would you want to put your company in the position where they have to WASTE $100 on shipping AND frustrate consumers? Don't you think the deeper issue here is BUY.COM inability to control their inventory system?

Spending anything over $300 that can die on you any time after 90 days without any warranty is NOT a good deal. It's a risk we are taking too. The price doesn't look ridiculously too good when you factor that in. We are not all rich people that can spend those type of money every 90 days. If I can afford it, why would I even want to buy refurbished stuff?? I would rather go and buy something brand new. 25-40% of the original price is the max anybody should pay for refurbished items.

ps. Who will take pity on the people that spend that much money on refurbished items only to have it go bad on them 90 days after without warranty. Will you come out onto the forum and defend us then?

you people make me laugh.
make sure you tell the LAWYER that you weren't sure what monitor you were buying as it IS MENTIONED IN THE THREAD TOPIC.
If buy.com has a Viewsonic listed I agree you should get a Viewsonic.
Rember Viewsonic bought Nokia so it is a Viewsonic and it can be advertised as such.If they do not send you the one advertised then call them and tell them so and ask for the proper monitor.
If it was a missprint send it back and ask for something for your troubles if they give you something find if not live and learn.

I have recieved some good deals from this forum and some not so good deals but you people that yell LAWYER everytime you don't get a item that was mispriced or misprinted are to much.If you read the news paper
on monday or tuesday you always see kmart,target or walmart with a small
add that says something like the advertised item or whatever it is was mispriced and the correct price is such and such GO SUE THEM.

I found a G810 21" monitor for $275. Its .22 and 1600x1280. Is this monitor as good as the one in this post. It is a flat square tube but not a Trinitron. Anyone know where to find a review?

Seems like the deal is dead, so i might as well just say something to people who are thinking about legal action:

I've been ordering from buy.com ever since they offered coupons..that's a LONG time ago. Since then, if I had ANY difficulty, they would always surpass my expectations when I called for help. Their customer support is amazing, and their return policies are great, too. What skin off your back is it if you get sent the wrong monitor? You'll be fully refunded, at the very least. I find it -very- hard to believe buy.com is in the business of switch-and-bait, and if this is the 2nd time it's happened in over 2-3 years, it's more likely because of misadvertising. It's in clearance, after all. You think they'd bother w/ another situation with just a few hundred items? Everyone would simply return them, and they'd be a couple thousand in the hole for the free shipping. Give buy.com a break and get a life, being bitter about a deal too good to be true is immature, because most often, deals like that ARE too good to be true.

MISTER 2 U,

This thread started out with EVERYONE thinking it was the Viewsonic 445PRO [good monitor].
Later, someone said something about Viewsonic buying Nokia's monitor line, and it being a Nokia.
Then, searching for "Nokia + the model # off buy.com" I found the specs page on the 445xi [bad monitor]. We didnt realize there could be a mix up until then.

Ok, here's my $.02

I've ordered a lot of things from Buy.com. I've been surprised by what's shown up at my door a couple of times, and I've noticed that Buy.com often has part numbers that don't match the manufacturers' part numbers. A very easy example is the simple part number for the Netgear FS516 switch that I just bought. Buy.com lists it as a FS516NA -- no idea where the NA came from. In this case, however, I got exactly what I wanted. The FS516.

A few people have mentioned that this monitor is being advertised as a Viewsonic and not a Nokia, and that the only 445 model that Viewsonic advertises is the 445PRO. This is not a valid argument guys (girls included)... Viewsonic manufactures and sells monitors under a variety of names. Ever seen an OptiQuest? How about a CyberVision? These are all monitors made and sold by Viewsonic under different brands. Nokia is no exception -- Viewsonic bought Nokia, however the monitors are not being restamped with toucans and a Viewsonic logo, they are still "Nokia" monitors. All markings, casings, serial numbers, etc. are Nokia.

My theory is that the monitor is going to be the 445Xi. Perhaps this was a "bait and switch", but more likely it was a marketing/web posting mix-up. Some poor confused intern was probably assigned to get the specs for these "Nokia" monitors that Buy.com somehow ended up with... all said poor intern probably found was the stuff on Viewsonic's site about the 445Pro, and hence the mix-up.

Nothing is guaranteed, especially when you're talking about a retailer as huge as Buy.com. So someone screwed up, BFG. Let's move on with our lives and find a similar deal so *I* can get a 21" sweet-ass monitor for $350 bones.

Of course, if you bastards actually end up getting the 445PRO for that price, I'll have to hunt you down and steal it.

Just placed a call to buy.com this morning. I courteously explained I am quite certain what they were advertsiing specification wise is likely not the monitor model being quoted. Before I even gave him my order number, he went on-hold on me for a few minutes, I then gave him my order number, he went on-hold another few minutes, came back to me and said bascially all the info he has is that on the web site. I explained to him that if the monitor being shipped is the more "inferior" model, that I would be returning it. I even offer to ask for a cancellation to save buy.com the shipping charges but again, the CSR has absolutley no additional information. When asked as to what additional number/people I can contact, all he said was to ask the manufacturer.

I am at a lost here. I am trying to save buy.com the hassle of shipping and having me return the monitor at their expenses; also by the reaction I got when I explained to him, it appeared to me he went on hold for "strange" reason (I had call buy.com CSR in the past regarding other orders and hadn't been placed on hold BEFORE giving out my order number. I might be wrong on this, but I just couldn't help but feel he knows more about the situation than he was willing to let me know.

I guess my point is I want to help out buy.com on saving these shipping charges but obviously my request is falling on deaf ears. Anyone else tried to call buy.com today regrading clarification on this monitor today?

To give buy.com a fair chance, I decided to call them again and this time the lady CSR who took the call was much more resourceful. I again explained clearly that I think there is a discrepancy between the model number and the specifications listed, gave her my order number and she went on-hold for what seems like an eternity.

She came back stating that while she still cannot confirm the model number of the monitor that is being shipped, she did tell me that the model number FUL445P259 (that of the 445Xi), is the model number given to them by Viewsonic, not a number from buy.com's internal inventory. She said I can have the option of cancelling the order now (or before it shipped), or the option of refusing the order on delivery.

So I am sensing the bottom line here REALLY is that it is indeed the 445Xi. So for those of you who don't want the Xi (which translate to most of us who ordered), it might be a good idea to call and cancel the order before it actually ships to save both yourself and buy.com the hassle.

Any other ideas, anyone?

I think the best thing is to wait to get the item, open box and see if it is correct monitor or not. If not, call buy.com and get return authorization and ship it back at their expense. No problems... And you can't sue for that, if they take the item back at their expense then what have they done wrong?

Update #3:

I just called buy.com to cancel my order for the monitor and surprsingly, while my order does show up on buy.com's system, they could not locate my order in the warehouse.. what the CSR explained, was that sometimes the order process through but the item was acutally out of stock (So much for true real time inventory). As we all remember, the stock number seemed to remained at 92 the day when the deal broke and then the next thing we saw was that it sold out.

So she did put in a request to the warehouse to cancel my order, stating that it may not prevent it from shipping, but again stated, as I have posted before that I could either refuse delivery by UPS, or request a RMA from buy.com if I did receive the monitor.

So the bottom line here is that many of us who did got in on the deal may have been out of luck regardless due to the fact that they were already out of stock when the ordere went through.

I tried to cancel my order last night through the website.
It said I would get an email within 1 day letting me know if my cancelation request went through.
Well, I never got an email, so I called up buy.com.
No help there for me either. Only thing she could confirm is that I put in a "cancellation request".

I put in a cancelling request on my order yesterday, but today it showed that it has been shipped and I have been given a tracking number. Oh well, just crossing my finger now for it to be the 1800 resolution monitor that they have advertised.

Mine says it was shipped yesterday and that the expected shipment received date would be the 29th, I guess they are not shipping from their wherehouse in So. Cal. or I should have it in a day or two. Hope people post what they get as soon as possible to know if we are getting what was advertised or if we should refuse shipment.

Mine got shipped also----one thing I noticed on the UPS tracking invoice is it stated a weight of 35LBS---definetly not a 21in. monitor---check your UPS invoices'---mine will arrive tomorrow and will let you all know results!
