rent issues

a friend of mine moved out with her then b/f and they both rented an apartment together

both their names are on the lease (it expires next july)

they broke up and now both people have moved back home but still have to pay for the apartment lease

the thing is her douchebag ex wont pay his half, he lost his job 3 weeks ago, (he thinks its funny appearently) so my friend's options are

A: only pay her half, get taken to court by the land lord and have her credit ruined
B: pay the entire lease by herself

either way she is getting screwed

i suggested to see a lawer and sue her ex, but i don't know if he has the money

would this be an easy case to win?

and are there any other ideas or solutions?

First, do option B.

Second, negotiate with landlord to get out of the lease early.

THEN sue douchebag ex-boyfriend.

Here is what to do, no lawyer needed.


Find out what it takes to break the lease, probable cheaper then paying the rest out. Send a CERTIFIED letter to other person saying the lease will be broken unless they pay their share and any other fees and bills from breaking lease. Give them 7 days. After that either they will pay of not. If not then break the lease and pay ALL the bills to close it out. AGAIN send a certfied letter to other person with a FINAL amount of all fees/bills. If they don;t pay then file a small claims court action. Make sure you have copies of EVERYTHING including checks and letter from the owner of the apartment.

I just had to sure a customer for not paying for some work on his truck. I did what I said above and had copies of all the bills an dletters I sent. I won and his bill went from $320 to $510 with all the extra fees and court cost.

She's not getting screwed. She knowingly signed a legal contract with someone she had/has no control over. IMHO that is just stupid. Now she has follow the terms of her contract. If I were her, and I'm glad I'm not, I would contact her landlord to see if there's any way to get out early.

Hmmm depending on the size of the claim, she might even be able to settle this in small claims court. Either way, court is her only legal recourse.


1. Why did she move in with her b/f in the first place?
2. Why did she move back home when shes paying for an apartment already?

She can tell the landlord to take legal action against the other leasee. She isn't stuck with the entire bill.

If both their names are on the lease, why can't she just pay her share and leave it at that? Won't the landlord/lady go after the Ex bf since he's the one not paying his share?

NO. They are BOTH liable for the rent, all of it. Even if she pays half the landlord would sue both of them as both of their names are on the lease.
