i cant think of wat he could use in his defense. It was plain and simple(it wasn't this quik, but the end story and the "done deal" is basic) i offered, he agreed, i got the money, and he says SORRY.

That's really, really poor trading practice (but that's already been established, huh).

If you bought the money order from the US Postal Service, having the money order refunded is simple as long as you've still got the stub and the receipt. I did this about two weeks ago and all they did was match the MO with the stub, asked for my ID, and I think I filled out some short little form. Yeah, they keep the fee for the MO but eh, what can you do?:|

All you can do is post his name and let other traders know about him backing out. You can't leave a Heatware when no payment/good was actually sent/received.

Okay, first of all this guy gave me a bad vibe from the start. First we decide (this is over AIM) that $65 shipped is fair and that he would pay first by MO (which I had to explain to him how they work, that didnt add to the good vibe of a trader). Then he keeps wanting me to change things and have me ship first. I didnt want to ship first to this one because 1. the bad vibe. and 2. the lack of any real evals (he does have a few ebay ones which he showed to me much later than this part of the conversation). If he doesnt want to pay first then dont agree to it. Simple as that, I'm not that hard up for the sale.

Now, he still agrees to send a MO, then, now he wants to cross ship. I'm sorry but somebody that wants to keep having it shipped to him right away w/o payment just irks me. You can ask lukmeg or FrostyPhrog, I have no problems with shipping or paying first if I feel comfortable with it.

Now to rectify the situation, if he wants to still send the MO first, since he already paid for it (by the way 7-11 has them for free, he says they dont where he is but who knows), thats fine. Keep in mind however, even now that he has the MO he still wants to change the stipulations of the deal and make me cross-ship now. I personally dont see that as dealing with me in good faith.

If he doesnt want to do as was agreed to, then he'll just have to eat the $1.50 or so that the MO cost him.

I await a reply I suppose.

This is pretty lame on A LOT of peoples part.

ALWAYS find out both sides of the story before you go running around pointing fingers and all this crap. There are 2 sides to every story, and it seems we have heard the other side of this one. The "unwritten rule" about selling to whoever you agree to sell to is null and void if you have any qualms about the other traders ethics.

Also I think it's interesting that he "was busy and didnt send out the MO"

Sure wish I had cross-shipped (<--Sarcasm). Last thing I want to deal with is "oh i was busy and didnt send it"

Also, try waiting for a reply to your PM before you going straight to the boards with it.

Like I said above, I have no problems with completing the deal with him if he wants to send it first

I am not going to ship first, or cross-ship because that is not how the deal was agreed to.

If he doesnt like that, then I guess the deal is over. It's not really my problem if he went ahead and got the MO, but then doesnt want to go through with the deal as agreed.

Personally, I think Durron has a case here. Espically with the shipping details.

Wiser, I think it was shady of you to hide some of the facts from us. Durron has layed it completely out on the table, its up to you now.

Oh well. I can see that this trade is going nowhere. Why can't you guys just settle for cross shipping or maybe pay abit more to ship to a reputable member as a middle person??

I shouldnt have to go through a bunch of crap with this guy when I have other people with good references (whom I have no problems shipping first to btw) who are interested in the processor.

But you agreed. So, there's really no point saying that you shouldn't have sold the chip to him.....

Yes, and i still will go through with the deal as agreed originally. I'm just saying I shouldnt have to go through with a deal that the other person is trying to change the details of.

And I'm also looking for Wiser, he isnt on AIM that I can see either.

I've had that happen to me before. Bought a zip drive from a guy, couple days AFTER I paypal'd him, he tells me someone offered me more so I'm selling it to him instead. Took about a week before I got my money back. Jerk.

why is this argument happening here instead of via pm or in the for sale/trade board ?

Btw, negative Heatware is generally reserved for cases when you've actually sent the seller money and do not get the goods.. now you are here trying to pressure the seller into cross shipping ? This is not a trend I like and I have over 80+ Heatware ..

Once a trader agrees to sell at a certain price, he is in a binding contract to follow through.

String him up!

This is a stupid argument in the wrong place, it should be taking place via PM, E-mail or AIM between buyer and seller.

We have 2 guys here both afraid of getting ripped off.

Find someone you both trust to receive both parties items and them forward them to the appropriate person. I would offer to do it myself except I have no means to test a 1+gig Celeron.

There is nothing here to warrant negative evals, all I see here is one guy over-eager which put a blip on another guys radar. This happens all the time, you can back out of a deal anytime if you have reservations about the other traders ethics, or ability to follow-through on a trade.
