I’m surprised he hasn’t granted it yet.First of all, there has been no ruling of a mistrial, and likely won’t be unless the prosecution or defense yet again bring up excluded or blatantly unconstitutional allegations in front of the jury.
But any such ruling would still be subject to appeal I believe.
A mistrial that dismisses case with prejudice is almost never granted, and if I were a gambler I’d wager good money that it won’t occur in this case. Near zero probability - barring the prosecution throwing the case, by repeating the same point in front of the jury again that caused the judge to blow up initially. But, being a dumbfuck isn’t a crime, especially more so when you’re 17. I think the defense is doing a better job of making their case than the prosecution, judge’s rules notwithstanding. There’s a good chance the only thing that sticks is the underage possession charge. If that’s the case, I wouldn’t say it’s a grave miscarriage of Justice. The victims will have their day with civil cases as well.
