After Democrats swept to power in 1992, the same year that the Supreme Court upheld Roe by a 5–4 vote in its Casey decision, there was a concerted effort in Congress to codify Roe by passing the Freedom of Choice Act (FOCA).
“In the weeks following Bill Clinton’s election, abortion rights groups said they were confident that a bill to codify a woman’s right to an abortion would become law within the first few months of the 103rd Congress,” Congressional Quarterly reported in May 1993. FOCA had passed out of committee in the Senate, but by May of 1993 divisions had emerged that threatened the bill: Supporters of the bill “feared a flood of floor amendments that they said would undermine the bill’s intent.”

Well they did rule that the executive can still manage foreign policy but they did make sure to reserve the idea that judges can seize control back at any time if they don’t like the executive’s policy.
This is one where Biden would just say the court is well outside the constitution and ignore them. You can't claim one president can create a policy but the next one can't change it, especially when the only reason is what party they are from.

It's the filibuster, gerrymandering, and too few districts that is killing Congress. If a single democrat wouldn't vote for something in 2009, it didn't even get a vote. Obama still passed the stimulus, auto bailout, dodd-frank, and ACA, over non-stop bullshit fear mongering from the right wing media. When was the last time republicans passed anything that wasn't a tax cut? No child left behind?

Mitch McConnell, ostensibly in exchange for the Senate Minority Leader agreeing not to hold up future federal nominations by the Biden White House, according to Yarmuth and other officials who confirmed the pending nomination

now, do i agree with it? no, fuck mcconnell. he's a piece of shit. and there's no real guarantee that mcconnell will hold true to his word, because he wasn't consistent with "SCOTUS picks shouldn't happen so close to an election"

but if biden can still shift the needle, that's better than not being able to nominate at all.

This is the most bonkers part of the ruling - Roberts admits it's covered by the statute and then just says that doesn't matter. His position is:
1) the law itself is constitutional
2) the regulation is consistent with the law
3) I think congress didn't really mean it though so I'm going to invalidate it anyway.


If Congress didn't mean it they are free to pass a new law limiting the EPA's authority. Roberts knows that won't happen though so he just 'passes' his own law to enact GOP policy.
This actually is the biggest flaw in the reasoning of these textural literalists who keep saying things can only happen if Congress explicitly says it. They put zero emphasis on the idea that Congress can also at anytime explicitly say the opposite of what an agency is doing and by not doing so are giving assent.

Still more than enough time. They could have been drafting bills between nov and Jan. Remember most of Congress is incumbents. They're not noobs. They should have bills coming out of their ears.

Like maybe they did this January 2021, but nothing got done in those first month's after Congress change. But all bills passed in the house that sat on Moscow Mitch's desk, did they have to go through house votes again? Like after impeachment 2, Senate could have put up to votes many bills. But if new Congress had to start from scratch, would explain those 24 days.

If a woman needs to travel from one of Gilead states, I would recommend purchasing a burner phone for the trip, and leave her regular phone back in Gilead, and only use cash for gas, food, etc. so there is no paper trail.

She doesn't need to be pregnant, or seeking an abortion, the mere fact she traveled to a state that doesn't subscribe to the Gilead agenda will become enough to get her accused of murder, or at least intent. The fact she went to visit her parents that live in a free state is immaterial.
