User uTorrent or Azureus and set it to FORCE encryption (meaning you can't connect to any client that doesn't support encryption). Set it to port 1720 (the VOIP port). I'm on Rogers and it's working for me so far.
Depending on where you live, you probably have more options the Rogers and Sympatico. I live in Ottawa, and there are quite a few small broadband ISPs that hardly anyone knows about, like Magma Communications
You can't copyright common words and names - in the upper midwest where lots of Scandinavians settled it is a quite common name. However I could copyright my own first name becase AFAIK, no one else has it. Besides you have no way of knowing whether he was referring to Linus from Peanuts (can't even copyright that) or Linus Torvalds (actually the one I first thought of when I saw that handle).
Only those living in the past would have thought of Linus from Peanuts first.

What's the big news? Throttling has been used for years. Read the T&C and check with Rogers to see what your cap is. My ISP has caps at 1.5, 4, 9 and 15 megs and I get what I pay for. Speed costs money.... how fast do you want to go?
