Sallie Mae and Chapter 7

I filed chapter 7 back in October, everything went through fine and I have been paying my loan from sallie mae since its federal and chapter 7 doesn't wipe it out. But today I called them because I could no longer access my account. I spoke to a gentleman and he asked if I filed bankruptcy, I said yes. He said I no longer have an account with them and I do not have to send money. Well obviously this can't be right, so what should I do call them back tomorrow and see if I can get something in writing about this?

Hmm, I always heard the only things that bankruptcy (7 of course) didn't clear were back taxes and student loans.

Yea same here, that's why I am so confused......only thing I can think of is maybe sallie mae sold my load off to a third party company

I think there are two types of student loans, private and government backed. The government loans can not be wiped out, but maybe the private ones can. In any event, you can either:

1) Call again and ask about the status of your account. *WARNING* Regardless of what people tell you, if you want to make payments on a loan that was wiped out in chapter 7, YOU CAN!! It is NOT against the law to start making payments again. It is stupid, but not illegal. It is illegal however for them to try to get you to pay on a cancelled debt. SO, just ask for your outstanding balance after your recent bankruptcy and if they can send you a statement on your account showing how much, if any, you owe. Dont offer to make payments yet. If they insist you owe nothing, get it in writing.

Okay thanks I will call my lawyer tomm and ask him first. If I don't owe them anything I wish I could get the money back I sent 3 days ago lol

No you should just bury your head in the sand and assume he's right.

Of course! When it comes to credit / loans, always always always get it in writing.
