Not true. If you jaywalk and step out in front of a moving car and the driver is not impaired he will not be charged unless it can be shown that he had ample time to react and take action to avoid hitting the pedestrian.

Most of the time you are deemed to have ample time to stop or avoid the accident.

In this case, he 1. was impaired 2. had ample time avoid contact, and 3. had ample room avoid contact
