SCOTUS 4-4 on Obama's immigration executive action - killing it.

SCOTUS decided in a 4-4 vote that Obama's executive order to shield illegal immigrants from deportation and to allow them to get temporary work permits is unconstitutional. Of course the 4-4 decision upholds the lower courts ruling effectively killing it.

The dreamer's portion is still intact.

Personally, I think this is the right decision. The executive branch went beyond the scope of its power effectively writing new immigration law. Thats, of course, the senates job.

Hillary is, as expected, still towing the party line, and I think Trump will crucify her for it. We'll see how this shakes out in the race.

I agree, hopefully Democrats can appoint at least two more justices to finally stop this nonsense once and for all. SCOTUS has been extremely right wing for far too long and it's time to clean house.

What's nice is that assuming two picks and that both of them are more liberal than what we have now that would move the median SCOTUS justice from Kennedy to Kagan. I can only imagine how many shitty rulings on abortion, campaign finance, etc could be done away with.

Worthless O admin betrayed legal immigrants last year by not ending indentured H1B servitude and providing job mobility. A relatively simple fix for people waiting in line for years and years. Instead, his admin gave de facto amnesty to 5 million lawbreakers - unlimited work authorization that even legal immigrants with American citizen children don't get. Such complete contempt for law abiding legal immigrants and blatant vote-bank politics deserves to get smacked down. I feel back for the illegals who were hoping to come out of the shadows but this is just.

Lets imagine president Trump puts forth an executive action on immigration deporting illegal immigrants because he couldn't get it passed in congress. How is that different than what Obama did? (constitutional-wise).

So according this this, someone on a tourist visa who comes and has a child in the US should be allowed to stay with unlimited work authorization.

Someone on *any* visa can do this. The result is increased immigration by some 10-20x.

Do you believe in unlimited immigration?

Actually if Scalia had been alive this would have been an even more of a smackdown, 5-4. Bleeding heart open borders liberals should be thankful it was 4-4 and they can bloviate about racists, etc.

They are both examples of the executive prioritizing the use of law enforcement resources. In effect orders already existed to deport all illegal immigrants, it just can't be enforced because we don't have enough cops, etc. So really no different. Trump's order would also be largely ineffectual.

This should also be followed by punishing employers who hire undocumented workers with meaningful fines and after a few violations prison time...

If no one is hiring immigrants who arrive illegally then there will be much less motivation for them to come over.

Meh, next Democratic president institutes a similar policy after replacing Scalia then it's a slam dunk. Easy peasy.

Why presume he wants unlimited immigration when it's simpler and more accurate to say he just doesn't believe in following the law.

I say pick one or the other; you either deport illegals or you remove all penalties to businesses for hiring them. I really don't care which at this point.

If Repubs don't confirm Obama's nom I have a pretty good idea of how Hillary's replacement will vote on whether to uphold Obama's executive powers.

The worst part is how selective the admin he cheerleads for is in "following a law' If you're a law abiding legal immigrant, every dot has to be correctly placed for the beaureaucrats in O's admin to them to consider it. A small mistake can cost dearly.

Sometimes, it depends on the caprice of the immigration officer. For example, legal employment based immigrants have to go get their visa stamped every three years outside the country. In the consulates, an officer can indefinitely delay your visa, with no explanation whatsoever, for however long he wants. Never mind an employer is waiting for you.

Want to be small government? Be a legal immigrant, especially from a country like India or china with extreme retrogression. You'll truly realize what it is to deal with a faceless, emotionless government entity, with no accountability, endless red tape, and no mechanisms available for redress.

Anyway, in such matters, O admin is all about the law, and we get no sympathy from Jhnnn and the rest of his bleeding hearts group. But hey, overstay the visa or jump across the border, suddenly you're awarded with work permits and travel permits and get to skip the entire visa process, and they'll vehemently support you.

I guess you have to fall a few levels of grace, and roll in the mud for the bit before liberals will deign to help you. Maybe they get off on the begging and groveling.

What gave you the idea that SCOTUS was supposed to be centrist? I mean if anything it has been very conservative for the last decade+ at least. (and arguably conservative for the last 3 decades)

People usually take 'centrist' to mean 'agrees with me'.
