Governments shouldn't be requiring licenses for handguns or marriages. The only real compelling state interest in licensing is when there is some need to certify skills where the lack of proficiency may harm others (e.g. driving, certain professional services providers, etc).

shouldn't and are are irrelevant at this point. Back to the question, do you think the religious right would back the Quaker?

You have a very good point...conservatives need to understand that this is a two-edged sword.


We've already seen the examples of how conservatives react when a Muslim attempts or is even perceived as attempting to exercise any type of religious right/freedom. They certainly don't come down on the side of religious freedom in those cases.

I'm sure most would not, but hypocrisy isn't illegal. Obviously both clerks are both legally and morally wrong not to issue the permits.

Too bad she should have resigned. Honestly I don't want to see jail time for her but I do want to ensure elected officials know they need to do their jobs.

You didn't really think this through, did you?

Unsure of what point you're trying to make here. Ownership of something and operation of it are two separate things. You can own a car without a drivers license, and even drive it on your private property without a license as there are effectively no risks to others in doing so. Why should owning a firearm be different?

Likewise if you want to simply own a firearm then permits are ridiculous. If you want to invoke firearms licensing for those who want to carry them in public then I have no problem with that, so long as the license is open to all like a drivers license. Being able to demonstrate a basic knowledge of basic firearm safety is reasonable government interest in that case and the permits should be issued at minimal cost to all who meet that basic threshold.

Here is the big question the gay couple that have been waiting for so long will they get the license from the stand in person or will they wait for her to ultimately comply and leave jail so they can be the first couple to apply on her first day back in the office.
I hope they wait its kind of disappointing to go this far and have some stand in sign the form.

I'm looking at it as a point and inspection that assuming she states she is going to comply then this is the test. I understand why she would be pissed about it.
They could have gone to another county to get the license but they felt she was being wrong. I'm wondering if what just occurred makes the original couple feel righted or complete?

I imagine that this is true for some. However, I was listening to a local conservative talk show on the radio this morning and they supported the SCOTUS decision. Imagine that! What's this world coming to?

While she's in jail, her back-up can start issuing same-sex marriage licenses again. So Davis should now recognize that her position is futile.

Davis has a choice: On the one hand she can agree to start issuing same-sex marriage licenses herself or she can resign her position as County Clerk, which in either case would result in her being let out of jail, or - on the other hand - she can continue to stand her ground (and stay in jail).

I think there comes a point where if your religious beliefs do not allow you to perform the duties of your job, then you should not in good faith persist in said job.

ASHLAND, Ky. — A federal judge here on Thursday ordered a Kentucky clerk jailed for contempt of court because of her refusal to issue marriage licenses to same-sex couples.

The clerk, Kim Davis of Rowan County, was ordered incarcerated after a hearing here before Judge David L. Bunning of Federal District Court. The contempt finding was another legal defeat for Ms. Davis, who has argued that she should not be forced to issue licenses that conflict with her religious beliefs.

“The court cannot condone the willful disobedience of its lawfully issued order,” Judge Bunning said. “If you give people the opportunity to choose which orders they follow, that’s what potentially causes problems.”

Judge Bunning said Ms. Davis would be released once she agreed to comply with his order and issue the marriage licenses.

Honestly, I don't see why she doesn't simply find another job that doesn't compel her to violate her religious beliefs.

I mean, I know these Muslim analogies are tired, but would you be OK with making "reasonable accommodations" for a Muslim employee who doesn't want to ring up and sell you a double-bacon cheese burger when you place an order for one?

This isn't what I would call "reasonable accommodation" -- it's borderline special treatment because I'm sure no other employee can refuse to perform their jobs while keeping them.

I'm all for religious freedom...of course, but a line has to be drawn somewhere.

Here's the thing about bigots...they never think they're bigots as they have rationalized their bigotry in a way that makes perfect sense to them. And the really sad part...they seem to be quite content living in this bubble, completely oblivious to their ignorance and mental depravity.

Don't want to do your job under the law, resign. It's not rocket surgery.

Methinks she is enjoying her 15 minutes of fame too much to do that. She could up a rich woman after this, either from donations for the Christian right, a book deal or lawsuit. We tend to glorify and enrich the worst amongst ourselves.

The court made the right decision. Not up to her to decide who can and can't marry. She should have stepped down.

On second thought, I'm persuaded and agree. This particular situation does go beyond what should be reasonably accommodated.
