I think she will resign in days. If that long. It's her only "principled" option.

I wonder if the county will hold a special election for someone to take over her position since she is in jail and unable to come to work. That would truly be the end because she would no longer have the position.

It's scary how openly they, with the exception of Christie, endorse the idea of the government being run based on the religious beliefs the employees. Where are the Constitutional Defenders who are usually so vocal?

The Defenders are usually cowards who hide behind things like the constitution, religion and rights such as freedom of speech to spew their hate - not tell it like it is or defend their freedom (hint: it's not really freedom when you oppress and harm someone else).

The reality though; they invoke a higher power, and it will come a'callin.

She's not a very reasonable person.

Her argument is extremely weak if she think God is/was using her to defeat gay marriage.

There was a huge opportunity for that to happen with the SCOTUS ruling, and even before then with Prop 8.

This seems more like a woman finding a way to claim she's being persecuted because of her faith, and to feed the likes of Bill O'Renob and Sean Hannidumb.

I don't think the county can do this, unless Davis is first impeached and convicted by the state legislature for willful failure to perform her duties of office.

But her backup in the County Clerk's office is fully empowered to step in and perform Davis's duties while David is unavailable to perform her duties (which will be the case as long as she remains in jail). And that's exactly what I think will happen. Davis may or may not resign (that decision solely rests with her), but the issuance of marriage licenses to Rowan County same-sex couples will certainly commence within the next few days.

Religious beliefs that are claimed by religious fanatics to be at odds with government duties MUST be accommodated, so long as those religious beliefs are Christian beliefs.

Most of them I'm not surprised to see on this list. Rubio was a bit of a disappointment as I thought he was better than to pander this way. Still wouldn't have voted for him, but he seemed like one of the more reasonable of the GOP clown car posse.

By the Judges words I'd guess they begin tomorrow. He essentially said to all the others in the office you will issue marriage licenses to everyone or you to will head to jail. Seems like nobody put up a fight.

Lesson to learn is don't troll a Judge.

If it were a Muslim, they'd be imposing Sharia law, and it'd be ROBBLE ROBBLE ROBBLE! Bring out the torches and pitchforks!

Wait, Muslims hold the same viewpoint on same-sex marriage, don't they? Does that mean all these GOP candidates are effectively defending Sharia law? :hmm:

Honestly, I don't see why she doesn't simply find another job that doesn't compel her to violate her religious beliefs.

I mean, I know these Muslim analogies are tired, but would you be OK with making "reasonable accommodations" for a Muslim employee who doesn't want to ring up and sell you a double-bacon cheese burger when you place an order for one?

This isn't what I would call "reasonable accommodation" -- it's borderline special treatment because I'm sure no other employee can refuse to perform their jobs while keeping them.

I'm all for religious freedom...of course, but a line has to be drawn somewhere.
Agreed. A reasonable accommodation for you to do your job should not include not having to do your job.

Methinks she is enjoying her 15 minutes of fame too much to do that. She could up a rich woman after this, either from donations for the Christian right, a book deal or lawsuit. We tend to glorify and enrich the worst amongst ourselves.

Haha the Judge did bring everyone else in to confirm undderstanding:

The judge said she left him with no alternative but to jail her, since fines alone would not serve to change her mind. She was escorted out of his courtroom by a deputy, although not in handcuffs, to be turned over to the custody of federal marshals.

The judge also told all five of her deputy clerks that they are free to issue licenses to all applicants, and also face fines or jail if they refuse to comply. He gave them a chance to meet with lawyers before returning to his courtroom to reveal their decisions.

The lawyer for Davis, whose defense is funded by the Liberty Counsel, a religious freedom group, argued that the deputy clerks can only issue licenses under Davis' authority, but the judge overrulled this objection.

Yeah it was a nice touch from the Judge to give her one last shot, then have her removed from the room to go to prison then ask everyone else to comply or be held in-contempt.

Oh yeah, all that damn right wing hypocrisy. But wait! Muslims are against same-sex marriage yet Democrats defend them as the victims of religious bigotry.

I wonder what would happen if a same sex couple ordered a wedding cake with bacon bits from a Muslim bakery? Who would win those Victim Olympics?
