I don't really see the big deal, unless the pack does specify to not sell it. If someone is willing to pay for it, then that person gets what he wants for the amount they're willing to pay. Yes it is expensive, so any smart person probably wont buy it.

What you're describing in this thread is copyright infringement, not theft.

I've posted this before: Please see Dowling v. United States (1985), in which the courts ruled on appeal that distributing copyrighted material did not constitute theft and those convictions were reversed against the defendant. A relevant passage from the delivered majority opinion:

Also take a look at the actual copyright law and, perhaps most relevant, first sale doctrine, the latter of which actually bit Microsoft in the ass on Microsoft v. Zamos.

I could be wrong about this. I'm not a lawyer. If you have a link to prove to me that reselling NFR software is legally considered theft, I'd like to see it.

Sad thing is, for every person out there blatantly selling these packs, there are more than a few
people who would have gladly had the house party and used the software

People are going to make a buck for sure but throwing that pack right up on CL probably wasn't
the brightest move either.

I would guess that's why he's mad? There are always people who no matter what will apply for anything at any cost to themselves if they believe there's a way to make a profit. Just like the people first in line for consoles, etc.

And at free there was no risk. I'd have thrown a party.. but I didn't apply for a kit anyway

Items are worth maybe $10 not including Win7. I got the XP pack with a bobble head and an XP baseball. I still see people try to sell them on ebay for $20 with no takers. I still have the baseball but I gave the bobble head away to a friend shorty after I got the pack. Nothing in this pack is in less supply than that XP pack so the only thing of real value is the copy of Win7.

If I had a nickel for every post I flag on CL. While some people have given Perknose a hard time about this, see how long your NFR post lasts - it wont. A lot people are watching.

They should do a better job of filtering however and we wouldnt have all the fraud taking place. Like the gigs section. You have people showing up and doing jobs, then the people that hired them not wanting to pay for the work! Then you have idiots that only spamalot making you click links so they only raise cash for their website and nothing else (lying from the beginning about their intent), others that phish data and resell it, have you send resumes and steal your identity, it just goes on and on and on.

So I do admire at least some people trying to do the right thing and at least make CL a somewhat decent place to visit.

I'm not unaware of it. But my impression is that "not for resale" applies primarily to retailers, and is usually printed on promo materials or individual items sold as part of a bundle. It's there so a retailer can't open the kit up and sell Windows 7 by itself.

I would assume that if these kits were bought, then first sale doctrine applies and one can legally sell them despite the NFR label. If the kit is given by Microsoft with the binding understanding that it's only for personal use, then it might get hairy. That's why I asked.
