I didn't feel like reading 8 pages of this thread....but does anybody think for a second that John Roberts will allow this case before the court? Assuming he does want to repeal Rowe (and I believe he does), he's too smart to do it in one swoop. Anyway last I checked Kennedy is still in support of abortion even if he goes the other way on partial birth. This is all moot, and SD should save there money.

I wonder if South Dakota will have to raise taxes to cover the increased welfare, education, medicaid, and crime costs.

OP needs to add Mississippi to the Title of the thread.

This time it is a Democrat that is pushing for it.

I suspect he is actually a Republican based on his comments and why is it his responsibility to act because it is "piecemeal" as he put it???

JACKSON, Miss. - A state House committee voted to ban most abortions in Mississippi, which already has some of the strictest abortion laws in the nation.

The Mississippi lawmaker who introduced the near-ban, Democrat Steve Holland, said he acted because he was tired of piecemeal attempts to add new abortion restrictions year after year.

Holland said he has voted for some abortion restrictions and against others in the past. "I have a strong dilemma within myself on this," Holland said. "I can only impregnate. I can't get pregnant myself."

The likelihood that the US SC overturns Roe v. Wade is so remote even with the addition of Justice Alito. It certainly will not happen overnight if ever. I suspect that few of the people discussing the Court's handling of abortion in Roe v. Wade actually are aware of the actual basis for legalized abortion.

I have no problem with the ban...although I would add the stipulation of both 'rape' and 'incest'....both having to be validated with proof.

I don't understand anyone's objection to a partial-birth abortion. To me, anyone who objects to that is not worth listening too, nor worth the waste of oxygen to debate.

There are 17 States with working Bills they are about to pass.

The argument of go to another State will no longer work for the Republicans that spit that spewage out.

Will the states abide by the federal district court rulings declaring these laws to be unconstitutional? Will it be necessary to send in the national guard? Will various politicians have to get arrested and charged with federal crimes? Could we see civil litigation seeking monetary damages against the states?

I wonder how this will affect people and businesses. Could you see some businesses electing to relocate out of the anti-choice states while others elect to locate to those states? I do foresee many college-educated people fleeing as a matter of principle. Perhaps this is just the first step in a Balkanization of the U.S., perhaps with a violent war to be fought over this issue in the future (aka "shoot'em for Jesus").

3-6-2006 S.D. Governor Signs Abortion Ban Into Law

The law, designed to raise a direct challenge to Roe v. Wade, the 1973 U.S. Supreme Court decision that legalized abortion, is scheduled to take effect July 1.

Under the law, doctors in South Dakota will face up to five years in prison for performing an abortion except when the procedure is necessary to save the mother's life.

Tennessee senate wades into abortion fight

NASHVILLE, Tenn. - The state Senate on Thursday passed a proposal to amend the Tennessee Constitution so that it doesn't guarantee a woman's right to an abortion.

The 24-9 vote was the first step of many toward officially amending the state constitution. The measure would go before voters if the General Assembly approves it twice over the next two years.

The state Supreme Court has ruled that the Tennessee Constitution grants women a greater right to abortion than the U.S. Constitution.

Abortion rights supporters are attacking the measure as a stepping stone to prohibiting all abortions in Tennessee if the U.S. Supreme Court overturns the landmark abortion decision in Roe v. Wade.

"The resolution is an all-out attack on the women of Tennessee and seeks to rob women of their right to make choices about their own health, safety and personal welfare," said Hedy Weinberg, executive director of the American Civil Liberties Union of Tennessee.

Sen. David Fowler, a Republican sponsor of the bill, proposed a similar resolution last year that cleared the Senate but stalled in a House committee.

"I regret this will cast me as being hardhearted, unsympathetic and unkind but that's not who I am," Fowler said.

Tennessee has a long process for amending its constitution, requiring approval by both chambers in session of the General Assembly, two-thirds approval by both chambers in the next session, and then approval by voters.

Several states are considering restrictions on abortion that eventually could end up before the U.S. Supreme Court. South Dakota's governor signed a law Monday that would prohibit all abortions except those necessary to save a mother's life.

Some opponents of abortion rights hope the additions of Justices John Roberts and Samuel Alito will make the court more likely to overturn Roe v. Wade, although a majority of the court still appears to support the 1973 ruling.

Let me get this straight... Manifest Destiny giving them the right to force their morality on everyone is perfectly fine, but the gov't giving scraps to the poor is atrocious?

I'm a libertarian but I'm also realistic in that I know it will take nothing short of a revolution to have a libertarian movement in our gov't.
