Should I report this incident?

Okay, weird thing happened to me tonite. I was inside an In'N'Out burger joint with some friends, when I got a call on my cellphone. When it seemed like it'd take longer than a few seconds, I got up to go outside to talk, since I didn't want to be rude. I walk out and a couple seconds later I hear someone say "Quit it". (Note, I don't remember the exact words). I turn to my left and there's this old big scraggly guy looking at me. Not really knowing what's up, I continue talking on the phone, turning away from the dude. Then I hear something like "Shut the F@#K up!". I turn back to the guy and notice that he's looking in my direction again. Here's part of the rest:

Me: Excuse me?
dude: Quit your yapping!
me: excuse me? (not quite believing what's happening)
dude: Shut the F@#K up!

At this point, I'm pretty pissed off (finally aware he's yelling at me).

me: what's your problem?
dude: Why don't you F@#king stop your yapping.

Here I am outside in'n'out (McDonald's type place for you non-californa guys), at least 10 feet away from him talking to my girlfriend on the phone. From this point, I can't remember the exact sequence of words, but I remember him calling me a pig, or talking like a pig. Calling me a short F@#k. (I'm 5'10", about the same as him) After maybe 30 seconds, I recognize this guy as the homeless person we (me and my roomies) have seen sprawled around the neighborhood. At one point he grabs his cane and walks towards me. I'm pissed enough to say something like "What the F@#k is your problem." And everytime he says something like "You talk like a F@#king pig", I'll say something like "What's your problem, you fat F@#k."

I know, I know. I should've just walked away when he first said something. But by the time I realized what was happening, I was pissed off big time. After maybe a minute of this back-and-forth stuff, my friend's come outside (not sure if they saw what was happening, I'll have to ask). Not really wanting to do anything more than this, I walk towards our car and that's the end. (Although I smiled at him the whole time we were leaving the parking lot and even waved goodbye.)

So, what should I do about this? I asked my friend's if I should call the cops or at least tell the people inside In'N'Out what was happening, but they said "If you were a homeless person, you'd be pissed off at the world, too." But, the more I think about it, maybe this could lead to something more serious in the future.

Here's a couple notes:

1. This happened in Sunnyvale, CA (silicon valley).
2. We've seen this guy around the area for the past couple years. He's often shirtless, sprawled on the side of the road in some grassy area.

So, any suggestions on what I should do about this? I could just forget about it, but it just seems weird not to at least warn someone or get it on record. When the guy picked up his cane, I'm pretty sure he didn't mean to use it to balance himself. The police must be aware of him, since I've seen him around a lot for the past few years...

Police probably won't do anything, most likely he has a mental "issue" that is untreated. In cases like his, he'd get help if he asked for it.

Though I could be wrong, depending on how your part of the country deals with people like this...

I'd just forget about it. Sounds like the guy is either mentally ill or drunk. I doubt the cops would do anything....

Don't bother. Something will happen and end up screwing you over if you do report it.

Report him for what? He didn't attack you. From what you say he didn't even verbally threaten you. I think the police would laugh at you, or humor you and do nothing. Don't waste their time with something like this.

I understand you being pissed off, cause he was being an ass, but I don't think there is much you can do about that.

well if you think that you might run into him again, or for some crazy reason he would attack you where you live, filing a report might be worthwhile as insurance for the future in case something happens. Then again I have no idea how the police station/legal system there would handle it, they might just laught at you.

He's most likely homeless because of mental issues. A staggering number of homeless are schizophrenic, which is usually how they end up there. Ignore him because he's just as likely to pick a fight with a street lamp. You just happened to be in the way.

Okay, couple responses:

1. If this was a restaurant where people were quietly eating dinner, and not some fast-food joint, my cell phone would've been on vibrate. But do people actually turn their phones to vibrate or go outside to answer their phones when they sit down in McDonald's or Burger King?

2. Someone complained that I was using a phone in public. It wasn't like I was standing right next to the guy when I was talking. The outdoor chairs are a good 10+ feet away from where I was talking. I could've been sitting at a table near him, talking to my friends, and we would've been a lot louder.

3. As for being verbally threatened, isn't "Quit your yapping", "Get the F@#K out of here", "You short f@#k", and "You talk like a dog" considered some sort of verbal abuse? BTW, I'm 5'10" and although I can sort of speak chinese, english has always been my first language.

4. Isn't getting up, grabbing a cane and walking towards someone while holding it in your hand sort of... threatening? I guess he might've been using it to balance himself, like a high-wire artist... but I kinda doubt that.

5. As for seeing this guy around, I saw him the next morning sitting outside the local McDonald's. As I mentioned before, my roomies and I have seen him sprawled out, shirtless, in small grass areas next to the street. It's not like we see him everyday, but often enough that we've noticed for the past couple years. If this were an urban neighborhood, I'd just say screw it. But, this is Sunnyvale, home of the $600,000 3-bedroom rambler and a household income of $100K would barely feed and house a family of 4.

6. As for telling the police, I don't expect them to put out a APB on him. But, in case other's in the area have had problems with this guy, I'd at least like to let them know that I had a run-in, too. The day I can't personally take care of one bum is the day I go back on creatine and protein shakes.

It's a scene that happens more frequently now. There's not enough money to keep the loonie bins open so they release these loonies into the world to "integrate" them with society. You just have to ignore them. No point in encouraging them.

If I were in your situation, that guy would have personally have gotten a visit from a masked individual later that night and given him a whoopin.
And then tell his ass " You shut the fvck up and quit your yappin "

I completely agree. There are people like that in the world you have to deal with, they have the right to bitch at you all they want. He didn't do anything illegal, so there'd be no point in reporting him.

OMG I KNOW WHO YOU'RE TLAKING ABOUT. he always sits around my neighboorhood and asks for money too. he's a little b!tch. i've seen him use the money to buy booze and cigarettes..:|

thats so weird, he was pissing me off too.

this is true. Theres no much you can do but swallow your pride and act like a better person since your not the one living on the street.
