evidence that they knew the food was tainted is NOT admissible in court, thanks to laws protecting them.

Subpoenas under the FDCA:

That is NOT for food.

Yes, it is moron.

Based on his previous username of StatsManD, I'm guessing statistics.

Wrong, they government does not have the power to punish them, unless the government can prove they did it with malic intentions.

You think that even if the company was notified that their food is tainted, and they continued to sell that tainted food, and bad things happened as a result, they couldn't be punished for those bad things happening?

The government also cannot tell me not to buy the food. The government doens't have that authority.

If the government tells you that the food is tainted, and you continue to buy it, you deserve to die.

Based on this thread... he definately didnt major in spelling.

Your entire argument is pointless... if someone were to deliberately infect food with a biowarfare ageant, that would fall under the homeland security antiterrorism acts... waiting for the FDA to do a recall would be meaningless...

Secondly... since it would not be known that there was any contamination, until the first few deaths were reported... having government recall power would not prevent any of these deaths anyways.

thirdly... in the event of an accidental contamination (as in what happened with the dog food recently) the companies will recall the products themselves... as it is bad for business to kill your customer base.

The government isnt the safety patrol... and we dont need to expand their power. In fact we need to cut the government down and remove all the socialistic programs within.

Maybe he failed out of that major and is now working on a new major to fail out of.
Maybe he should take a course in metallurgy though - that way he can tell the difference between an aluminum foil hat and a tinfoil hat.

How will the government know that the food is contaminated unless the manufacturer tells them about it? That's no different than the manufacturer recalling the food themselves, only now the government has to hear about it and then tell them to do it. That's a waste of time and money when the manufacturer is either going to do it themselves anyway or isn't going to tell the government about it anyway.

It is by definition malicious (intending to cause harm without legal justification). Like all products, food is subject to an implied warranty of being fit for sale. If you have a food item out there you know is not fit for sale, you are obligated to recall it or face punishment.

Neither 1, nor 3 are countless unless you forget what comes after zero or two.

Maybe OP is getting confused by the pet food recall situation. That industry does not have most of these regulations.

Because quite possibly, it's the government that's going to figure it out. Certain illnesses are mandated to be reported to the department of health. If your doctor figures out that you have food poisoning from e-coli, where you ate, what you ate, etc. is going to the department of health. If they end up with a bunch of cases where people ate at the same restaurant, they're the ones who are going to put it together. Restaurants, stores, etc., would have a tough time deciphering this information against a background of people who call and complain that they have food poisoning from a product they ate 30 minutes ago (when in reality, they simply have a stomach flu and the symptoms just began to show.)

What does that have to do with anything? Are you assuming he's using speech recognition technology to post on ATOT?

For some reason, I just picture the guy reading aloud as he types in a holier than thou kind of voice.
