And maybe tool is a strong word, but he decided to drink underage, got caught, and is now trying to get out of it, which seems kind of wrong to me.

That being said, I do give him and his friends a lot of credit for having a designated driver.

I accept any punishment I receive. That doesn't mean I'm not going to try to get out of it if that's a possibility.
what are your parents saying about it?

that's hindsight. a kid @ 16 is afraid and he'll basically do whatever the cop asks.
the cop was a prick imho.

Under Missouri law if you are visibly intoxicated you're screwed..

The DA or assistant DA will problem offer you some kind of diversion agreement. You'll have to pay a fine, take some classes, be on probation and possibly have some community service. That is if you are a first time offender.

No (I'm not sure what exactly you mean by training rules btw). Thankfully since I'm only a sophomore I have 2 more years of playing. Its frustrating because I'm #4 varsity so I'm definitely hurting the team..

Are you sure? According to MO state law in order to get an expungement I must meet 2 criteria:

# The person has not been convicted of any other alcohol-related offense at the time of the application for expungement; and
# The person has had no other contacts with law enforcement (i.e. arrest, charge) which were alcohol-related

Nowhere does it say anything about fines or classes.

No (I'm not sure what exactly you mean by training rules btw). Thankfully since I'm only a sophomore I have 2 more years of playing. Its frustrating because I'm #4 varsity so I'm definitely hurting the team..

training rules... like an athletic code of conduct. you know, rules that say if you are caught drinking or using drugs that you will be suspended from the team or whatever.

my high school had a whole contract drawn up that athletes and their parents had to read and sign before you could play that sport. it also explained the consequences of not abiding by the rules.

I'm not sure on MO state law, but I am speaking based on my experience with Indiana state law. I was arrested on minor consumption and the above is what I went through with the exception of no community service because I fully cooperated with the arresting officers and they documented that on my arrest ticket.

Wait a minute here. Regardless of what your BAL was, did you actually have any beer with you. MIP's are for getting caught with beer in the car or in your hand, not in your system. I'd attach from that angle. Or just pay the fine and move on. The cop was just doing some fund raising for his little town.
