Let's just say, I don't go out much, and I don't care for parties. I have been to dinner sorts of things at friends' houses, but they don't drink to excess. You know, maybe a wine or something, but of course, no wine for me. I find the taste and smell to be about as pleasant as that of isopropyl alcohol.

You should not have taken the breathalyzer test

It doesn't matter...you can be charged with MIP without it. Not sure about his state, but it's only a violation here..just a fine. Not a big deal.

Not in Missouri, you just have to have it in your system to get the MIP charge. Basically here they can pull you over if they even have a thought that you might have alcohol in your system.

Thats how it was at my school, any student athelete had to sign a paper saying they wouldnt do drugs and alcohol. It didn't stop anyone but they still had to sign it.

While I don't think it is worth paying a lot money to fight it bacause it 'probably' won't have a big effect on the rest of your life; you could try to argue a lack of probable cause.

If the cops lied about the light being out then everything after the stop should be suppressed; however the cops can say a number of things to get over the need for probable cause:

they saw you leaving a large party that had minors and alcohol
they driver was weaving
they saw a occupant taking a drink/holding a can

Try to get a consultation with an attorney and ask how much trouble you can actually get in, and also inquire if the courts offer a diversion program instead of any type of juvenile 'record'.

BTW: I got caught buying beer when I was 15 and we just had to go to court and testify against the seller. Nothing was ever on my 'record'.

I think my BAC is still higher from last night than yours was.

You didn't do anything horribly wrong, other than just being a teenager and being in the wrong place at the wrong time, so I'd suggest ignoring the Taliban Nazis in this thread. I give you guys huge props for having a designated driver.

You guys are are morons for having a designated driver who drank, AND who couldn't pass a field sobriety test with a .021 BAC. Even one beer for a DD is stupid when the BAC limit for minors is so low.

But if the cop did lie about the tail light being out, I hope the whole thing gets thrown out. He has no business stopping people for no reason. I got stopped once for driving too close to the yellow line. Asshole cop. :roll:

I live to astonish and amaze.
I don't care for the flavor of alcohol, nor do I wish to ingest anything that would compromise my discipline in any way. I've got enough funky brain chemicals that do screwy things to influence thought and judgment as it is.

The closest I get to being drunk is when I'm sleep deprived. Once I've been awake for about 20 hours straight, everything becomes funny; I'll generally laugh at the stupidest little things, but I can also get irritable.

Did the cop car have a dashboard cam? Seems like that would confirm or deny the taillight story. Dunno how you would approach that though, or how much good it would actually do you.

One of our young weighbour, 20, lost his driver license a last year for DUI so he got in with a drunk driver to go home after a party, JUST LIKE YOU.

He did not look very good in his coffin.


Sad realy, I got pics of the accident scene. There is a cross on the side of the road at that spot now.

Consider youself lucky.

Never take the sobriety tests. Never. Never ever ever. The cop usually doesn't administer it properly, so your chances of passing even when sober are around 70%. Not good odds when a DUI is on the line.

(the exceptions are the tests required by law such as the breathalyzer)

You can just say "No officer, I refuse to take a field sobriety test"? I'm guessing then he'd require the breathalyzer?

I was stopped on the side of a street, car running, while a friend ran up to his apartment to get some things. A cop pulled up alongside me and asked me what I was doing and if I had been drinking (I had a couple beers but was in no way drunk). He ended up giving me some of sobriety tests: saying the alphabet in normal order, not reverse (failed it :roll, watching his flashlight with my eyes (failed it :roll, and maybe something else, I don't remember. Bunch of fuckin crap. Had to leave the car there and call for a ride. Fuck that fuckin pig.

The first time I EVER had alcohol in my life was this past Christmas (now 18) when I was cleaning up the table for the family I was visiting. Everyone else was downstairs playing a game and so I take a swig of the stuff. I feel this burn in my mouth and I start to think, "what the hell am I doing, is this something I really want to even start to like?" I spit it up and continue on. I continue to live alcohol and drug free. Not only does that keep me healthy, but it also saves me a shitload of money.

Yeah, he said I failed. But Jesus Christ, I'd have to be extremely fucking drunk to do that, and I was nowhere near that. Like I said, a couple beers over a period of probably an hour and a half, which I believe for my body size and such would be under .08. The cop was a dick, but in this town that seems to be not out of the ordinary.
