Huh? Yeah, in my book, he was an ass. I was perfectly fucking fine to drive, as I said before. Two beers in an hour and thirty minutes gets me a DUI? Don't think so.

Beats me. Only reason I can think of was I said it a little too fast, cause I was nervous (never been pulled over before).

Actually, 3-4 beers for a teenager can put you over the legal limit if drunk under 1 hour, even less if you're thin.
I am thin, but I had two and I wasn't a teenager.

That is BS, because there was no probable cause for the cop to pull him over.

There were 5 of us in the car in total. A long line of cars were leaving the party and we were driving fine but we ended up being the ones that got pulled over. The cops said we had a tail light out. At the time we didn't know but we just said ok. Long story short, the driver is given sobriety tests, passes 3 out of 4 but then we're all given breathalyzer tests. The driver blew a .021 (we would've been off if he had blown below .020..) and the rest of us blew .022, .08, .07, and a .151 for me. Then we're all cuffed, taken to jail, and then our parents came and picked us up.

Now I don't want to hear about how what I did was bad, or about how I had what was coming to me. I'm just wondering if it's possible to get our M.I.P's reversed because as it turns out the cops lied about the tail light. It's not out (nor was it).

Also, are all 5 of us going to have to get lawyers, or if just one or two of us do and we get off on the tail light thing, will we all get off?

0.021? I would think the breathalyzer would have some sort of variability in the testing.

Erratic driving? Pulling in a line out of a party of rowdy teenagers who smelled of alcohol?

If you blew anything at all you were under the influence, under age.

How do I know all this ?
Sister is an attorney

I hear her talk about stuff like this all the time.

Its not a major deal and not going to be on your permanent record.

Wrong, the legal limit for minors in Missouri and many other states is .02%.

It's .08% here in Cali (which is still crap)

For an underage driver in CA, their license is confiscated at 0.01% for DUI.

Parents grounded me for 2 weeks. Meh. Mom said next time get a better DD or don't drink and then drive myself. Dad said don't be anywhere near alcohol, or parties where there is alcohol. I'm going to listen to Mom on this one because every party has alcohol and I like friends..

I drink alone, yeah, with nobody else.
I drink alone, yeah, with nobody else.
Yeah, you know when I drink alone, I prefer to be by myself.

Now, every morning, just before breakfast,
I don't want no coffee or tea.
Just me and my good buddy Weiser.
That's all I ever need.

Cause I drink alone, yeah, with nobody else.
I drink alone, yeah, with nobody else.
Yeah, you know when I drink alone, I prefer to be by myself.

Now, the other night I lay sleeping,
And I woke from a terrible dream.
So I called up my pal, Jack Daniels,
And his partner Jimmy Beam.

And we drank alone, yeah, with nobody else.
We drank alone, yeah, with nobody else.
Yeah, you know when I drink alone, I prefer to be by myself.

Well, the other night I got invited to a party,
But I stayed home instead.
Just me and my pal Johnny Walker,
And his brothers Black and Red.

And we drank alone, yeah, with nobody else.
We drank alone, yeah, with nobody else.
Yeah, you know when I drink alone, I prefer to be by myself.

Well, my whole family done give up on me,
And it makes me feel so bad.
The only one who'll hang out with me
Is my dear old Granddad.

And we drink alone, yeah, with nobody else.
We drink alone, yeah, with nobody else.

You messed up, your friends messed up. Now it's time to deal with the consequences. It's a part of the growing up process. This will teach you what it means to be responsible. Don't worry about it too much, it's not the end of the world. Think of it this way, 20 years from now you're going to look back while telling your buddies about it over some beers. The difference is, you'll be legal then.

I still don't see why those are good reasons to drink at 16...

Btw, I'm 18 and drug/alcohol free.

It does. If you're under 21, you're not supposed to have any alcohol in your system...so you've got 0.02 leeway.

hahahahahahahahaha. Are you frickin serious? if an officer pulled you over without probable cause you would just go with the flow? that's insane.

Get an attorney. He will file a suppression motion. If you win the motion, the charges/fine will liekly be dropped. I would recommend a separate attorney.

ummm, the .08 is not for minors. CA has a zero tolerance policy for minors AFAIK

yes, you're right. Either way, its ridiculous to "take responsibility" when your rights have been violated.

Agreed. Lights are funny, though...sometimes they work, stop working, and start again..it's happened to me before.

Honestly, pay the fine and do the time. It will most likely be cheaper in the end. From what I have heard from friends who had MIPs in TX, it is removed off your record once you are of legal age. So I wouldn't worry about it.

Edit: I did some research and found that if you are under 18 and get an MIP it goes to your Juvenile record. When you are no longer a minor that juvenile record is sealed. When you become legal your adult record is open. So if you were 18 I would tell you not to let the MIP ride and fight it. But since you are 16, just pay the fine and get over it.

Why did you even take the breathalyser test? You only have to take it if you are driving in many states. You could have legally refused to take the test and would have not had to deal with a M.I.P.

i would chalk it up to experience, it isn't like you have to live will killing someone by drunk driving or something

he had a DD...?

that blew higher than he did in the breathalyzer...
