Unfortunately if I recall correctly, any store with video cards like that in the Philly area have them behind locked glass. But then again since it had a 9200 sticker on it, they probably stuck it out on normal shelves

Not much to glean from your link ("session expired"). But it stands to reason that you'd have to prove your purchase before getting any warranty service on it, unless they can ascertain a purchase time period from a serial number. I know Canon does that for some printers. It all depends upon their policy.

Explain how you got this....was the box an x800xl box or 9200 box?

if it was a 9200 box, how did you know an x800xl was in there?

if it was an x800xl box, with a 9200 sticker on it, what is that sticker and how did the cashier not see the X800XL on the box?

Which store was this?

What state is this?

Nice find. Hope their inventory doesn't come up short. Or they trace it to your bedroom with that new code they put in high end video cards. Just peek out the window before you answer the door. You should be OK.

Heh, you guys are such noobs. People working at retail stores do this crap all the time. Put in wrong label, have friend come in and buy it, eBay.

What a bunch for billshut. In Michigan, just to give you an example, the legal provisions are as follows: RETAIL FRAUD [MCL 750.356c & .356d] Stealing merchandise (items offered for sale to the public) while the store is open for business, "price switching", or trying to get a fraudulent refund from a store. Retail Fraud is a theft crime requiring proof that the item was taken intentionally (not accidentally), with the intent to steal.

It appears that no intent to defraud the business was present. tvbi may have had a legal duty to alert the store that a much higher priced good was unintentionally sold to him, which would have given tvbi the choice of using the item and paying the store the difference between the paid price and the reasonable price for the item, or of making the item available to the store for pickup and a refund of the original purchase price.

However, since tvbi is no expert, he has no duty to inspect the purchased item beyond an outside look at the item. Heck, I couldn't tell, AGP, PCI-E, ISA, whatever... who knows, right, guys? And isn't that a videocard for a MAC anyways, correct?

This is one reason why 50% of all "shrinkage" (i.e. loss) is from internal causes. 50% is external (i.e. shoplifting).

So despite stores trying to put in nazi like shoplifter protections **cough BB cough** they could reduce shrinkage just as much, if not more by watching the employees and putting in better tracking for stuff before it hits shelves.

I once got a Leadtek GF2 Pro 64MB for the price of a MX64 but didn't notice until I left the store.
That card is still working today.

edit: I thought I was buying a MX. Then after I took off the plastic wrap and box I realised that it was a GTS Pro 64. Overclocked to 240/400 nice.
