I don't think it is. There is nothing illegal about looking at porn. Either way, both of them are wasting company time doing legal activities.

Straight from my Employee Guide Book. I would assume that MikeyIs4Dcats' handbook says something similar. Also included is "The use of such equipment and software for private purposes is strictly prohibited. Employees using this equipment for personal purposes do so at their own risk." The difference is, this douchebag got caught. Besides, he apparently has it coming to him.

Ok...I couldn't decide for the longest time what to do. I figured if he gets canned right now, I'll suffer because I rely on him for some things that I don't want to have to assume the responsibility for at the moment. I took the second copy he printed, wrote "So you printed this by accident twice!?!" I'm not that stupid" on it in black marker, and stuck it in his top desk drawer. I also cut off his rights to the color laser.

I feel it was highly inappropriate to print them. We have a somewhat laid back culture here, and no one is going to get fired for receiving a dirty email, but printing it goes to a higher level. Doing anything where another employee can witness it is a problem. And we're not talking some joke email or lewd cartoon, but explicit pornography. He's on an even shorter leash now, and next time he screws up, his ass is grass.

He is not directly beneath me, but I have been given certain latititudes as I am in a senior position and have more experience. I could not fire him, but I could give him a dressing down or report him to my boss. I voiced disapproval when I interrupted his first printout and after my present, he knows where he stands. Like I said, he's been underperforming and there has been much talk of his future here, but I'd rather he be canned for his other failings, not this particular issue. Also, cutting him loose now would burden me on an upcoming project.

Well in this crazy world, I would rat him out. Imagine if a female coworker saw this. He gets busted. He then says "MikeyIs4Dcats thought it was cool when he saw them." I would also say that it depends on the person. Technically that could be sexual harassment if someone else would have picked them up. Our color printer we pay per sheet in our contract so he'd lose rights to print pretty damn quickly if that happened.

EDIT: Even better.. Wait until he leaves for the day and then pin up the pictures in his cube and make up some excuse for the boss to walk by. heh.
