Again. This was no accident. It was negligent and likely reckless endangerment. Charge him. There were acts of either of those that caused it.
Hell whenever I load unload my weapons or even handle them muzzle is in a direction that I'm ok if a bullet going out of it. Some dude swept his muzzle in my direction investigating a failure and I ducked and cussed him out. Safety first and foremost.
How could you not consider this an accident? Not saying nobody's to blame, but they didn't shoot somebody in the head on purpose.
