I think the problem is that the backlight is set to a very high brightness with no way to adjust it lower. The brightness and contrast sliders do not effect the backlight (these controls just tweak the RGB values like the sliders in your video card's control panel). Lack of backlight control also makes this panel too bright when used in a dark environment.
Has anyone else compared this to their other LCD's blacks? I'm using the Dell 2001FP as reference.

Check and see if your monitor has the "high light" set to full. Push the button 2nd from the bottom. Then push either one of the 2nd or 3rd buttons from the top to manipulate which setting is enabled and select "off". Note that the contrast, brightness, and position controls in this menu are not for the monitor as a whole, but for the area and position of the highlighted area.

No dead pixels/sparkles/tearing/black lines/burning smell/excessive heat. It may have a slight buzzing from the speakers but I don't use them anyway.
I am using a different DVI cable and also have my xbox360 hooked up via the VGA cable. My video card is an ancient eVGA 6600. DVDs run great and some HD clips may stutter but nothing that can be blamed on the monitor.
I used my AMEX so any issues even beyond the 14 day return period should be dealt with painlessly.

Much of the discussion of refresh rate does not apply to the liquid crystal portion of an LCD monitor. This is because while a CRT monitor uses the same mechanism for both illumination and imaging, LCDs employ a separate backlight to illuminate the image being portrayed by the LCD's liquid crystal shutters. The shutters themselves do not have a "refresh rate" as such due to the fact that they always stay at whatever opacity they were last instructed to continuously, and do not become more or less transparent until instructed to produce a different opacity.
The closest thing liquid crystal shutters have to a refresh rate is their response time, while nearly all LCD backlights (most notably fluorescent cathodes, which commonly operate at ~200Hz) have a separate figure known as flicker, which describes how many times a second the backlight pulses on and off.
