From an article about Nelson Mandela fake sign language

Buxton called on the South African authorities to "name and shame that gentleman."

The same can be done with Ethan Couch. Repeat his name, repeat his offenses. Let the word spread that he's a bad man.

Then Eric's family can sue you for defamation of character :$ This kid isn't going to learn from his mistake.

Watch none of these media outlets get sued. Can't sue if it is true. Well you could, but you could beat it pro se and just have it cost you the time.

Why the hell does Anandtech tolerate having basically white supremacists on this board?

He backtracked later to clarify that he meant other privilege. I don't believe him however, since he's a WN.

So, you think what happened here is "natural"? That the legal team for this brat could make up a condition for what he did and sell a judge on it?

What is "natural" about this? If it were natural, you or I could do the same thing and expect a similar result. Instead, I'd bank that the very mention of some made up psychological issue in court would get you a lot of laughs.

I disagree with the lenient sentence. At the same time, I recognize that the rich will always be in a position to hire better lawyers than us.

I'm guessing the "affluenza" thing was meant as a joke, not as a serious defense/disease. Some judges/juries would be repulsed by such a joke making light of what had happened, others might be receptive to it. Maybe this lawyer knew this judge and wasn't taking as much of a risk making the joke... I don't know.

But regardless, I disagree with the sentence. I disagreed with OJ's wealth/fame privilege getting him off too.

I just understand that these sort of unfair outcomes are part of life. Not saying we can't try to achieve a higher level of fairness particularly in the legal system... but you have to pick your battles. You have to know which unfairnesses are fixable, which can only be mitigated somewhat, and which aren't going anywhere.

More importantly this case is an issue of Wealth privilege. Pretty hard to work to mitigate wealth privilege when a lot of people are confused about what this issue is. Take for example:

For those who still claim white privilege doesn't exist get a load of this...

Difference, OJ and GZ found not guilty because lack of evidence to convict.

This kid was found guilty but because his parents are so rich and privileged they didn't teach him right from wrong and he is not responsible so no jail. BTW - something most people here decry for inner city crime.

No, there was plenty of evidence for OJ, and GZ wasn't guilty.

But go ahead, keep crying racism where it doesn't exist, that certainly won't backfire on you...

Putting the kid in jail is really the only appropriate thing to do in cases like this. He's not going to learn a fucking thing except "money gets you out of trouble" by getting probation for killing 4 people...20-life MIGHT cure his severe case of affluenza.

The kid really needs a wake-up call...and having his hands slapped ain't gonna do it.

Sometimes it isn't about rehabilitation...it's about punishment for actions.
Screw what the kid needs, this should be purely about punishment and prevention. This is why we need minimum sentencing. If you're driving intoxicated and kill someone, the minimum possible sentence should be at least ten years actually served in prison. REAL prison, not country club tennis court lock your own cell or don't prison.

And OP, this is wealth privilege, not white privilege. Buy the best lawyers (or luck into the most liberal judge) and get leniency for killing. This is why we need stiff minimum sentencing requirements.

I agree. Although I am somewhat pessimistic about abolishing wealth privilege any time soon, if it were up to me this kid would probably be put to death over this. Not really joking, either.

Oh, those 6 people prove that privilege does not exist! Welp, that settles it. If Eric looked different and came from a poorer background, Eric would have gotten the maximum sentence for his crime...or something close to it.

Lets recap here, the kid dodged a possible 20 year sentence for what he did because he has "Affluenza". So, when you have "Affluenza" you are able to:

  • Steal Alcohol from a store
  • Drive under the influence of said Alcohol (at 3x the legal limit!)
  • Kill 4 people
  • Claim that you don't know right from wrong cause mommy and daddy were too busy to teach you
  • Have a judge agree with this
  • Get sentenced instead to 10 years probation and a lovely vacation to a 450K/yr "rehab" paradise.

Privilege exists. Race might be a factor but money always is. The family bought the best lawyers money could afford. Some trailer park redneck? Screwed. That's my issue here. Someone bought the result and the op blames it on being white with nothing to back that up.

Exactly. I think this little scumbag should be in jail for 15 years for what he did, but he was able to avoid consequences for his crimes because of his (parents) wealth. Wealth brings privilege, but I haven't seen any indication that the race of the guy had anything to do with the outcome. Had he been poor (and still white), he'd likely be in jail as well.

This kid killed four people.

Want to send a message to drunks and rich brats that their money and youth and whiteness or whatever else won't get them out of consequences?

Hang him on live TV. Message loud and clear. Watch DUIs get rarer.

What's somewhat odd is this Judge is a registered Republican and with that being said chances are slim as to being a liberal judge.

The fact this case was tried in a juvenile court the judge's hands were tied when it comes to sentencing. Though it appears that the judge is doing things that will first get this kid into in-patient treatment and then a lengthy probation period. Any screw ups after the kid becomes 18 will result in this probation period becoming an incarceration period.

Judge Jean Boyd told the court she would not release Couch to his parents, but would work to find the teen a long-term treatment facility.

Couch was sentenced by a juvenile court judge Tuesday. If he violates the terms of his probation, he could face up to 10 years of incarceration, according to a statement from the Tarrant County Criminal District Attorney's Office.

(The judge) fashioned a sentence that is going to keep Ethan under the thumb of the justice system for the next 10 years," he said. "And if Ethan doesn't do what he's supposed to do, if he has one misstep at all, then this judge, or an adult judge when he's transferred, can then incarcerate him."

Different judges can be liberal about different things. I know one otherwise totally conservative person who tried like hell to prevent a conviction in a DUI case (.4 BAC but no wreck) and only voted with the majority because "I've got to get home and feed my dogs".

Given that he just walked after killing four people with felonious behavior I can't imagine what he'd have to do to actually get incarcerated. But certainly the major screwup here was in trying this in juvenile court. I assume that's either a prosecutorial decision or another judge.

I think it would be more appropriate to drag behind a car until dead.

This isn't North Korea, bud. I agree he should be punished, but now, you're talkin crazy.

Sounds like you are support privilege to me

When are people going to realize that justice can be only simulated by our legal institutions? Justice is served by the righteous.

From the same article "Prosecutors had asked for the maximum of 20 years behind bars."

how was the judge's hand's tied if prosecutors asked for the maximum sentence of 20 years behind bars and the judge gave him probation?

This fucker should be hung by his balls in a public square and beaten to a slow agonizing death. The family's money should be dispersed amongst the family and friends of those lost.

No need for me to read the next 2 pages of this thread. This post ends it for me. This is what needs to happen. This is my emotional response.

Now for my logical response.

The kid needs prison time of 10 years mandatory with possibility of parole after that point with a maximum sentence of 20 years depending on results from behavioral and psychological evaluations.
The owner of the truck needs to pay the victims and their families, as well as the most closely affected friends of victims a combined total of 50% of all available assets in the truck owner's possession, 25% of all available assets are to be used for the purchasing of prolonged psychological therapy for the victims, and the remaining 25% of assets will be used for the trucks owner to live his own life or start a new company.
After the kid is released from prison he will spend the next 5 years on strict probation with behavioral monitoring, with any and all forms of alcohol or drug consumption resulting in his direct return to prison for the remainder of his life. After 5 years of successful probation with behavioral monitoring, he will then spend another 5 years on general probation, permitted to consume alcohol in driving legal quantities only, regardless if he drives or not. If found in violation, he returns to prison for the remainder of his life.
After 5 years of general probation, he is off probation and is a free man.
Sounds like a good deal compared to the deal his victims got.
