If the coupon was legit, and if the store was legally obligated to accept it (I'm not sure how Starbucks organizes their stores, but not all locations "choose to participate" in certain coupon deals), THEN Starbucks is responsible for all $4 or so of coffee that they promised. And not a cent more.

If someone walked out on a $5 tab, you can bet that Starbucks wouldn't be suing them for $114 million. Your analogy SUCKS.

The lawyer is going for a class action lawsuit. Sure each person might only have been denied a 4 dollar cup of coffee but when you added up all the people who didn't get the free coffee then you get the 114 million dollars.

The fine print only goes so far and if the copoun was sent out to employees of a store that is not partipating then that stores has some real problems and because they already partipated in part of the deal.

yup, i hope he wins. i understand that it is a ridiculous amount, but as far as i am concerned - since starbucks made the mistake of sending out the coupons they have to honor it and eat up the loss. this will teach them a lesson.

Seriously: Most coupons here have some small print on them, like an expiration date, "valid in participating stores", "as long as supplies last". Sounds like a rookie mistake.

Regardless, coupons -- particularly copies of coupons received and printed off the internet through unofficial channels -- do not legally have to honored. Clearly you don't spend a lot of time in Hot Deals.

Sadly, I've come across lawyers who are almost as clueless/desperate as this one. Usually they're solo practitioners in a financial bind, trying to milk a company for a settlement.
