Well, yes. For most of the 19th Century there was no such thing as radio or television. Mass media back then was print, so the President Addressed the nation and Congress in that format. The Constitution requires that the President 'give to the Congress Information of the State of the Union, and recommend to their Consideration such measures as he shall judge necessary and expedient. ' So to be fair the State of the Union is a required part of the President's job, but making it a speech is not. There is a lot more history to it, but suffice it to say that it is one of those 'norms' that is not exactly a law, but is very much a part of how The United States Government works. We have a real problem with no officially encoding those things and just letting it run on precedent, which is the very thing Trump abused.
In one case an entire industry is basically immune to lawsuits concerning their product, in another a small group of specific companies have limited liability from one specific product, for a limited time frame, and it does not say that people can't sue for damages at all, it just says that if they do the must instead sue the Federal Government and it set up the Countermeasures Injury Compensation Program specifically to handle it. Baiscally the Federal Government is saying that we authorized the rush job, we will take responsibility if it goes wrong.
