i agree. If the marine in the OP did this, i don't think anyone would have an issue. The issue is the fact he felt he needed to jump straight to shooting the guy.

Hell.. he's a TRAINED MARINE. if he needed to shoot him... shoot him in the foot... the leg... the arm... ALL reasonable uses of force.

WHY did he need to shoot to kill. I haven't seen anything which indicated he was in mortal danger.

hitting those targets is far harder than the movies make it seem to be. there's a reason people are taught to aim at COM.

This old-timer had a history of verbally harassing people who looked at his precious lawn funny. I know I would be pissed if that old pansy started verbally harassing me because my dog pees on his stupid lawn. Dogs have a tendency to pee outdoors (duh) and it's hard to tell they're about to do it...unlike if it were to drop a turd. I don't condone assaulting the old man but lethal force? Come on...the guy should be in prison for a few years for killing another person because it was murder. And he better stop verbally harassing people over stupid stuff concerning his yard that nobody cares about but himself.

Or what, you gonna go punch him in the face?

Under NH law, it's illegal for your dog to pee on someone else's property. I imagine other states have similar laws as well. Just because you don't care about someone else's lawn doesn't mean you can do whatever you like with it.

Illinois is one of 2 states where there is no concealed carry. Our 2nd amendment is denied in this state.

If the guy let his dog piss in someone else's yard and then argued with the guy about it, he needed to be shot in the face.

So much wrong with this. Don't know the law in the area, but if there is castle doctrine that would trump a lot.

Showing a gun is illegal though as a threat. Personally I'd have tried to kick his ass too after that. I walk my dog and clean up after them, I keep everything to the swales and still there are asshats looking to start a fight over my dog pissing on grass.

You sir are a PUTZ! I guess the US Marines don't stand a chance against the NZ military of Sauron and his minion of orcs. However, I do agree that it would be scary to get shot at by your airforce of winged sheep, though. :awe: Get a life. You seem to suffer from a lack of intelligence.

Showing a gun is not necessary illegal, it varies by state.

In Texas, the threat of lethal force is authorized where the use of lethal force is authorized. Meaning if you can shoot the person, you can draw and threaten to shoot the person.

Additionally, the requirements for the use of lethal force are a reasonable fear for your life. The question in TX would have been was the man reasonable in fearing for his life. If so, showing the weapon is justified. Then, after he was punched I don't think anyone can argue fearing for his life is reasonable.

So as someone mentioned earlier, in Texas this would likely not result in any charges. I can't speak for any other states.

Can't tell what's going on here, but if a judge/jury found it reasonable to give him probation for 4 years for killing a guy... we can assume that there was some REASONABLE cause.

Anyway... 23 year old guy sounded like a douche.

When I first started reading the story it sounded like he killed the puppy and I was like, "Nooo!! Evil old man! Poor puppy!"

If I cannot have a gun on my person, my right to bear arms is infringed.

Nope. Right of the PEOPLE, seperate from the militia. If it said the right of the MILITIA to keep and bear arms, you would be correct. Since it says people, you are incorrect.

If the amendment read

"A well-educated electorate being necessary to the preservation of a free society, the right of the people to read and compose books shall not be infringed."

Would you assume that meant only the well educated could have and read books?

Of course not.

The Second Amendment was established to ensure the POPULATION was armed. The entire population was, and is, the militia. Well regulated only meant trained. In that it was every able bodied man's responsibility to train with his weapon.

In the Bill of rights and Constitution the state is always separate from "the people." In every instance, "the people" are the individual citizens separate from the government.

we're talking about a 69 year old senior vs a 23 old kid. how else is he going to defend himself against someone younger?
