It absolutely amazes me ATOT would defend this. The only reason they do is because they worship Marines. The other branches of the military have FAR more honorable men than the Marines do. I remember the military times or another military newspaper years ago did a survey amongst all the branches of the military and members of the other branches of the military were more likely to report crimes committed by their fellow members while Marines were more likely to not report those crimes. And these were SERIOUS crimes like murder/rape/etc.
Which branch were you in?

Chances are, history would have changed enough such that he would not be born. His great grandmother would have spent the rest of her career as a pleasure servant, though.

It's Gaynor. Who's to say she didn't? It would go a long ways towards explaining his inimitable personal charm.

As for this story, there seems to be conflicting published reports of what actually occurred. In the end, I think both parties were primitive asshats. No winners here.

The guy assaulted him first. That makes this self-defense. Murder not found.

Hmm, well this does seem rather cowardly. You're a marine not some pussy that hides behind his guns. To me using a gun is a cowardly act. Not saying that sometimes it isn't necessary, but it is the truth all the same.

I'm not against CC just against idiots/pussies flashing a piece like it's no tomorrow. There comes a time to draw and kill and this was not one of 'em.

Dogs, tasers and batons (and OC, certain restraint holds, hands-on, bean bags, pepperballs, etc) are classified as non-deadly or less-lethal force. Certainly you can use a baton as deadly force (e.g. with a strike to the head), but you can do the same with a screwdriver. That does not mean that the use of a screwdriver constitutes deadly force under all circumstances, does it? However, shooting someone ANYWHERE constitutes deadly force.

If you're going to disagree with me here, post a law that backs you up.

yes i know, i was an MP for 10 years. Everyday at guardmount the use of deadly force was read to us along with other "stuff" like intent, opportunity and capability that we had to ensure were in play before we pulled the trigger.

This is absolutely false. Funches immediately left Clements' property after his dog urinated. Clements followed him down the street, initiated a verbal argument, brandished his pistol, and later shot Funches in front of Funches' aunt's home.

I question your sanity if you think that Clements' behavior was in any way appropriate.

i question weather or not you can read.

I'm considerably older than 23, yet would pose a serious threat to a 69 year old man, former Marine or not. That doesn't make me unique. A large number of men would be.

The dog peeing was the start of the confrontation, not the cause of the shooting.

Under the circumstances as we can know it this seems a reasonable sentence.

And so what if a dog pisses on your lawn? That's what dogs do fuck head. Mary the Marine needs to get over his prized lawn.

Normally I'd be all for defending the marine but I'd have to say, if the guy just punched him, shooting him to death was a little overboard. The dead guy obviously showed poor judgment (if someone flashed a gun at me, I'd shut my ass up and just leave) but couldn't the guy just shoot up in the air or something first?

No. Either shoot to kill or dont shoot at all. Whether or not he should have pulled the trigger is up for debate.

I don't know what to think on this one. The whole thing is just bizarre. It wasn't murder, but I kinda feel like some jail time was warranted. The judge who gave him the sentence is known for harsh sentencing too. So I assume that as the whole story unfolded in court, a more clear picture of how things really happened is just not being translated in the news story.
