Yes. He had to go get the shotgun out of the house, and go shoot the kid IN HIS OWN YARD. Plenty of premeditation, IMO.

the NRA isn't stupid enough to defend this type of action. no prosecutor will mitigate a murder charge to manslaughter because of provocation [in this case] (hahaha, forgot to add that last bit).

I live down the street from this kid. My wifes best friend is a teacher at his school. Sucks for his family and friends. We tend to have alot of crazy people living sround here.

No but the people that live across the street from me are crazy. Always have police over around dinner time.The mom was put in the back of a police car one night and she kicked out the window with her bare feet. I have only lived there for a few years. I grew up in another town about five miles from there.

joedrake, it doesn't matter how PISSED OFF or REPEATERLY HARRASSED the old guy was. It doesn't matter if the kid was a smartass, or if his parents were jerks, or if he/they deserved punishment. I'm sure they did.

Legally and ethically the only thing that does matter is that the kid was not posing a direct threat to the old man's life. Without that, it's murder, plain and simple, no matter what the events leading up to it were.

For the record I'm a gun nut also. Most people I know who are into firearms take safety, ethics and self-defense extremely seriously - and tend to come down very hard on the ones who don't. We understand that no matter how many millions of responsible, law-abiding gun owners there are out there, we'll always be judged by the behavior of a few trigger-happy idiots.

I remember a story about a guy who got fed up with kids street racing on his block so one night he poured motor oil on the street. I forgot how many people this killed and hurt. I believe he was convicted for manslaugher.

I'm not defending the guy, but i live next to an old man who's daughter and grandson come to visit all the time. his grandson must be borderline retarded, because he'll stand out on the front lawn with a stick and bang on the fence for hours at a time. We'll go out there and say "would you please stop that" and then he goes out to the back deck and beats on it, causing our 9mo daughter to wake up.

He also shoots a BB gun at an empty 2 litre bottle, which means the BB ricochets god knows where. I know it's hit our house a few times, but never any windows or cars. I mean this is the kinda kid that pulls a plant hanger out of the ground and spears the fish in his grandfather's koi pond and kicks stray cats and such.

I think the guy should go to prison etc. but I'm not saying such things haven't crossed my mind a few times.

The shooting took place just after 3 p.m. in the 800 block of Hawthorne Drive in Union Township, a street that doesn't have sidewalks.

Could have something to do with why people are stepping into his yard.

You cannot do that either - if you have vicious dogs they must be kept secured. They cannot just run around your front yard on a leash either because they could kill a toddler etc.

I think you're flamebaiting and I dont see Darwin involved at all in this picture. Why does everyone think that anytime something dies Darwin was obviously involved. This man is old fragile and probably is mentally instable. I would hardly say that I believe him to be a more fit example of our species than the kid was.
