How is shooting the kid any different than keeping visicious guard dogs that would rip the kid to shreds if he encroached?

Because the kid could reasonably expect the vicious guard dogs to tear him to shreds if he encroached, whereas no one would reasonably expect the old coot to fvking shoot them just for walking on his lawn.

W/e: I don't think that he should have shot the kid, but you have to cut the man some slack. I mean what if someone was doing something to PISS you off for FIVE years? Lets say you know someone that has a gun and doesn't like a certain thing. You're not gonna do this "certain thing" CONTINUOUSLY for five years and not expect to get shot.

what's funny, is that they even censor the audio recording. i agree with all who said fence is better. murdering the kid, no matter the circumstances, is a bit extreme. i kinda doubt the kid was threating the guy's life. what's also funny, is that he admits it without a problem. even calling 911 to report it. if just killed a kid, would you report it too the Police?

it's kind of difficult to NOT admit it... kid lying shot in your front yard... I think they'd find his shotgun. That or maybe he figured the kid wouldn't die.. or since the old bat was 66, he didn't give a damn.

I support the right to own guns because I support the Bill of Rights. But the people who think shooting people and dogs because they are walking on their yards is a good idea are giving cause me to reconsider my position.

Well, if you KNOW you have a physcopath living near you and you KNOW that he gets easily pissed about his yard and you KNOW he's been warning you for FIVE years to stay the hell off his yard, why in God's name would you continue to walk on it? If you're TOO stupid to not realize that a cranky, old, mentally instable, man, that you have been PISSING-OFF for FIVE years might do something insane, then maybe your genes should be removed from the "gene-pool".

Note: I'm not saying the kid should get ALL of the blame, but I'm just saying, that it is not all the man's fault.
Example: Let's say that you were a scawny, obnoxious person. If you go around to like 240lb+, 6'5" body-builders and start making fun of their girlfriends/mothers while calling them names, you can't expect not to get punched, can you? Sure, its not LEGAL, but you pissed that guy off and brought it on yourself.

If you go around to like 240lb+, 6'5" body-builders and start making fun of their girlfriends/mothers while calling them names, you can't expect not to get punched, can you? The kid should get none of the blame. As has been previously stated in this thread a 15 year old walking on this guys lawn does not justify the use of deadly force period. If it had been ongoing for 5 years then the 66 year old is more to blame than the 15 year old. It states there were no police records of any on going conflict so if the 66 year old man is to be believed he started this fight with a 10 year old kid and allowed to continue unresolved for 5 years. I expect a 61 year old man to be smarter and understand his legal options before I would expect a 10 year old kid to understand that the old guy might snap and kill him for something as trivial as walking on a lawn.

I shot my neighbors dog on his property. SOB would'nt stop barking. Cops did nothing.

I think I'd let this guy off if I were on the jury.

Doesn't seem like anyone actually read the second article:

The shooting took place just after 3 p.m. in the 800 block of Hawthorne Drive in Union Township, a street that doesn't have sidewalks.

Witnesses say the teenager was shot because he stepped in Martin's yard as he was walking down the street.

Sounds like the edge of the yard runs right up to the street, and the kid was walking along the edge of the street/yard.

I can sort of see joedrake's point. If you look the wrong way a Hispanic Gang, they WILL come after you (know this from 1st hand experience) so you don't look at them. Even so, the gang is not justified in their actions.

Yes the kid was acting stupid if he knew about the old guy's obession + gun. Still, you don't murder someone whose pissing you off. I'd say the blame is 97% on the old guy, 3% on the kid.

So what? There are some military installation in nevada you will be shot dead for tresspassing and in TX you can shot someone on your property after dark or stealing stuff. There was a repo man shot dead in tx recently as he was leaving with truck. Rights are what ever rights we want them to be - don't hold yourself as oracle of them.

And as I understand it, the last 2 feet of the yard next to the street isn't technically yours, it belongs to the state.

Simple, involuntary manslaughter. Punching someone and shooting someone are two different acts completely. One, you do not intend to kill. The other you do.

You can't honestly expect to point a shotgun at someone and pull the trigger TWICE!!! and not expect to kill them.

Judging from this you have a very one sided view of property rights:

So your standard is that if your neighbors property annoys you you can kill it without warning while it is on his property. Then I have to assume that your neighbor would have been justified in killing you since you violated his property rights twice with 1 act.
