I'm not sure why Eric was on the Apple board, but if Google followed their original Android roadmap, their flagship phones would still have physical qwerty keyboards. This is why the G1 had a slide out keyboard and now every Nexus phone after it no longer has this.
RIM has some physical qwerty keyboards and some all-touch phones. They aren't being sued.

The Android OS has responded to what consumers want. There are still Android phones with qwerty keyboards to this day, but they are less popular.
Android's UI was built upon physical keys, which is why on screen menus haven't been introduced until ICS.
That's absolutely true. But so what? Are products not allowed to evolve?
Android has too much momentum to be killed. That's true but Apple has been winning some of these lawsuits in case you were wondering. In fact, judges in at least three countries have made rulings in favor of Apple. While most of these rulings are still subject to change, it does point to the very real possibility of Samsung being bent over by Apple and potentially changing the cell phone landscape.
Apple has won a few patent lawsuits against Android tablets and has a few qualms with Samsung's Touchwiz interface (especially Touchwiz 3.0 without using Widgets). However, Samsung just keeps on craking out new tablets that are free from the rulings. In the smartphone category, Apple may have had a legitimate beef with the design of the Samsung Vibrant (a variant of the original Galaxy S), and a few icons in TouchWiz may need to be changed, but I don't think Apple has a chance to get any tranction in barring the entire Galaxy S series; especially since the Galaxy S II no longer looks nearly so iPhone like, and soon enough they'll all be running Android 4.0 anyway, which is a different beast altogether.
