Stood up to my work today

For the past year I worked for a local movie theater, until recently I found a summer job making websites for $2/hr more and its a lot more relaxed. I told my manager at the theater I was taking a 3 month leave of absence for the summer for another job. About a month earlier, I had turned in my summer hours, with june 9-16th blocked off as I was with my church on a mission trip to Mississippi for Habitiat and the Katrina victims

Needless to say, I must have gotten an email with the schedule on it saying I was supposed to work that saturday (I had no internet access in MS to check it regardless) and we didn't come home until Sunday.

When I got home and found out I missed, I called and apologized/re-explained to an assistant manager what happened.


Went in today to pick up my last paycheck and low and behold there was a corporate form which I was supposed to sign before they would give me my check (worth $150) which would go onto my file and lead to possible firing if anything else had happened in the future. Needless to say, they would not let me not sign it since it was somehow my fault?

I wrote the following in the sign here: "I do not give my consent and refuse to sign this - (555)555-5555 (my tele)"

They knew at least 3 weeks a head of time, plus I was on a leave of absence.... not my fault if you ask me. I'm not siging my life away just because they tell me to

They have no right to deny you your paycheck. I'm not legally trained, but it sounds to be like you can have a good case, don't know if I'd bother since its a $150.

They wouldn't let you sign the form? Do you mean they wouldn't give you your check unless you signed the form?

They cannot deny you your earned income....in fact I'm betting they're breaking some sort of law if they intentionally hold your paycheck beyond payday. Anyway, yeah, just tell them to fire you and take your money. There's a million other jobs just like yours you can go fill.

They can't actually make you sign anything, and they cannot withold your paycheck unless you sign it. Stand your ground, and you'll get your paycheck without signing. like Gooberlx2 said, fvck 'em...there's a million jobs out there.

Right...basically you were written up. Any employer I've been with that's written me up requires me to sign on the form, or can fire me if I refuse (really, they can fire you anyway). They're establishing a paper trail for the next time you screw up (in their eyes). It's really nothing to get worked up about though.

Point is I didn't screw up - I told them a month ahead of time I was not available that week + I was on a summer leave of absence which the GM knew about

Point is I didn't screw up - I told them a month ahead of time I was not available that week + I was on a summer leave of absence which the GM knew about

Which is why you didn't sign it So you original statement was actually false: "they would not let me just leave the signature blank - they were making my sign it", and you like to argue with people agreeing with you. cool!

Regardless, they don't have to honor a "leave of absence". They could very well let you go over that, but they didn't so stop making such a big deal about it. There are also plenty more jobs out there.

Exactly. Besides that, you're an employee at will, which means they can fire you over anything or nothing with or without a document signed by you. Unless the reason for firing you is protected by law, then they can fire you for any reason whatsoever.

They can't hold your paycheck legally. Call the corporate office if not call the labor dept in your state.

Just for the future, things get better as you get better jobs. It seems like the less money you make the more headaches there are. I had more problems working for $7 an hour at Pizza Hut than I've had in any of my past few jobs in office settings. You still have to deal with the usual bit of craziness, but it seems the better the paycheck is, the better the working environment is. As a rule
