There is (presumably) no law in your state requiring you to roll your window down all the way, as I've never heard of any such law in any state. That said, unless you had a camera filming at the time, I would probably advise you to just follow his request as cops have a tendency to go apeshit ballistic when someone dares not comply.

I'm all for flexing rights, but if you're doing to without some means to keep the cop accountable, you're asking for trouble.

I find that cops are much more responsive if you shout loudly so they can hear you very well. They are around those sirens and guns so much that many have hearing loss.

Not enough to be reasonable suspicion. The same way not letting the police search your home without a warrant is not considered reasonable suspicion.

They have the right to ask you to get out of the car and you have the right to refuse.

You are correct that refusing to comply with rolling down the window does not equate to reasonable suspicion. Just as refusing consent to a search doesn't equate to RS either.

You are completely incorrect about orders given to exit the vehicle. An officer has the authority to order you out of a vehicle at any time at his discretion. Failing to do so can and usually does end in you being forcibly removed and charged with obstruction or a similar charge depending on state.

I might have gotten it confused with the situation that a third party was recording cops from another car.

driver HAS to identify himself when pulled over for a traffic offense
failure to do so will result in arrest for traffic charges and interfering

there is no law stating you have to completely roll down your window period

you could roll down your window a smidgy crack and poke your id and insurance out if u feel so is necessary.


BUT, federal courts have ruled that officers can control the location of where occupants sit. If they say, exit the vehicle, you must comply. "officer safety" can be something as much as, "i was alone, veh occupied 4 times, people acting shifty and i could tell they were moving but i couldnt tell what they were doing.

also, if you are a dick and you get a dick officer, how about a full arrest with towing your car over a speeding ticket? that is completely legal


overall, rumors are that people who videotape and dont roll down windows or talk to cops are exponentially more likely to get ticketed

we need to document each case so that the public is aware. i plan to eventually compile all of these threads and upload them to my FTP site (F The Police site).

If this thread is a good example of such documentation, your reason for compiling this information is:

a) nothing happened here
b) what idiots do to annoy police officers

?

PS - I'm not the sort of person who says "well, if you looked at a police officer wrong, they're perfectly justified to <whatever just happened to some poor sod>".

I am always polite. but i do not answere 90% of the questions they ask. you can do it in a polite yet firm way. I have never got my car searched or my time wasted.

That said, I've never been arrested for anything and I fucking hate cops with a passion. Nearly every one I've met is a power tripping douche bag.

You can refuse, but if there's a law that states your car windows must be operable, you'll get a ticket for that too.

But way to knock it out of the park with the improbable hypothetical scenarios.

As long as you're in your car, it's pretty much just a question of whether or not you get a Ticket. If you are taken out at any time for a more detailed roadside chat... then Things Have Changed, and not at all for the better.

seriously. lol. you want to see a cop freak the fuck out, get out of your vehicle without being asked after getting pulled over.

if you want to escape with the minimum of hassle, roll down your window, turn your car off, take your keys out of the ignition, and leave your hands in plain sight.

legally required? of course not. but why needlessly antagonize the police? it's just going to make your life harder.
