stopped for speeding (+18 in a 65zone).

I cracked the window open because its cold outside. (it's Jan.)
he tell me to roll it down. I comply.

i have nothing to hide. i'm guilty and will pay the fine.

but I got the feeling I could have refused his order???

It's more of a thing that makes his life easier. You're right that you could have... but tread lightly as, if you're rude about it, you have yourself to blame if now there's probable cause to search your car... (I know... ATOT keep your panties on, I'm talking reality, not theory.)

In the end, it was simply an inconvenience for you that wasn't worth the trouble of finding out the alternative. Consider your own time saved. You only had to pay with a few mins of coldness.

There is (presumably) no law in your state requiring you to roll your window down all the way, as I've never heard of any such law in any state. That said, unless you had a camera filming at the time, I would probably advise you to just follow his request as cops have a tendency to go apeshit ballistic when someone dares not comply.

I'm all for flexing rights, but if you're doing to without some means to keep the cop accountable, you're asking for trouble.

I doubt you could have refused and not had any repercussions. At the very least it would give the cop reasonable suspicion of maybe alcohol on the breath, pot in the car or just the idea that maybe you are hiding something. Cop has the right to order you out of the vehicle if they believe it will make them safer. If they make you get out of the car the odds of getting just a warning went away completely and the odds of them looking for anything else to nail you with just went up.

Now in a cold place I would hazard to guess a reasonable cop would realize why you are doing it and not do anything about it but if it were me and they asked me to roll down all the way I would do it.

that is such idiotic advice....all you are doing is provoking the cop! If the cop did not ask you to get out of your car and you do so anyways, well your the one who is going to suffer!!

As long as you're in your car, it's pretty much just a question of whether or not you get a Ticket. If you are taken out at any time for a more detailed roadside chat... then Things Have Changed, and not at all for the better.

Now in a cold place I would hazard to guess a reasonable cop would realize why you are doing it and not do anything about it but if it were me and they asked me to roll down all the way I would do it.

In a cold place the cop is standing outside in the weather without the benefit of a car heater and is FAR more uncomfortable than whoever is inside the car, even if the window is open. Doing anything to slow down the process will not go well for the driver.

He would then ask you to step out of the car. You would have to comply.

Not enough to be reasonable suspicion. The same way not letting the police search your home without a warrant is not considered reasonable suspicion.

They have the right to ask you to get out of the car and you have the right to refuse.

Do they not need grounds to do that over your way?....sounds a bit heavy handed of the law to me....

If you get stopped by the police do the following:

1. Shut your engine off
2. Turn on your interior light
3. Roll the window down, whichever side the officer is approaching the vehicle
4. Place both hands on the steering wheel
5. Don't appear hostile - you don't know why you're stopped

You'll be surprised how many warnings you'll get instead of a ticket.
