You seriously need to get over your TEOTWAWKI predictions before we have a Jim Jones type deal over in Nemesis land. That shit is eating you up. Fact is times may get tight but we are still better off than 99% of the world. We are blessed with huge natural resources and people resources who, at the end of the day, we come out of this economic malaise relatively unscathed excepting your children's credit rating which I find repulsive you aid and abet them in ruining it.

29% interest rate? What the fuck? I don't use cards often, but think mine were 8 or 9% last time I looked a month or so ago.

No I'm young. I had 850 2 years ago. I'm not using the fica as a e-penis and I'm not going to give you my personal information to prove it (that would be e-penis worthy) so I guess this is where we are.

Its actually a great idea if you never ever plan on financing anything or using your credit again.

Too bad this is the real world, where credit is life.

I thought credit reports only went back like 7 years or something.

At any rate, we got Barack Obama so yeah.

That is the way it is supposed to be, but the problem is that debt keeps getting sold again and again and again and again. Every time that happens, the 7 year rule for that line item on your report resets. In addition, many have found ways to sell that debt to THEMSELVES even though that is not supposed to happen. This means that the debt remains on your report forever. The only kind of debt that you can sometimes work around is that which accumulated due to medical needs, but even then it really hurts you.

I highly disagree with how this system works. People make mistakes sometimes and they should be given a more reasonable chance to recover from those mistakes if they can show that they have learned to be more fiscally responsible.

You really don't know what you are talking about wrt debt.

It doesn't matter if you debt is resold a hundred times. The clock starts once it goes into default. Period. End of story.

At that point, once seven years passes, they (the original debtor nor any collection agencies) cannot report a thing to your credit. If they do, you are legally entitled to damages. The only way to reset the clock from their standpoint is if you make any kind of payment to the account which resets the clock.

They do have the option of trying to get a judgment against you but that is only good for ten years from the date of judgment. .

I agree. GE Money Bank is the worst. I have very large credit lines with all my non-GE backed cards, the places they represent, $300 tops. I don't know what FICO score they are looking at but it certainly isn't mine.

That is 100% incorrect and against the FDCPA. If any of your 3 credit reports have re-aged debts (which is what you are explaining) please, get yourself a consumer advocacy/protection lawyer and sue these junk-debt buyers. It is the only way these scum go away.

The clock starts clicking on the date of last payment. As long as you never pay another dime and make no arrangements, in 7 years the CRA's have to remove it. If a collection agency misreports this date, it is a direct violation of the aforementioned Act.

I cannot disclose the names of the CA's that I have had to sue to get bullshit off my credit report, but I can tell you it is $1000 for each violation and the lawyer makes 3x that amount in fees as part of the agreement.

By your own admission you attended 1/5 of your highschool classes (apologize if I missed the number). Are you sure your math is up to snuff?
and if the shit hits the fan so bad I'm fucked beyond belief I can use my cc to eat. food is important so the cc stays by me.
No, you can't. You think they'll keep your line of credit open if defaults are through the roof and your balance starts going up predictably each month? I have an exceptional credit score and flawless history with citicards and they jacked my interest rate up to about 16% from 11% at the end of last year for no apparent reason at all. Now instead of putting $300 through on that card (gas) each month and paying it off they get 0. A quick google shows you that many people are having credit limits cut back or killed. I used to see my tens of thousands in available credit card credit as a backup, too--a worse case, but it isn't. My only worse case now is my savings and my brutalized 401k. That is at least mine. The rest is a gift and can be taketh away.

I have about 44k. Not trying to one-up you but that is exactly what it is, but my credit score is only high 700s last time I checked it. I do doubt you have an 850 although it varies with agency, but at least one of them as a limit at 850, almost a theoretical one. I imagine less than 1% of people have it that high because it's hard to even determine exactly what variables in the formula would bring a person up to that point.

Decent post until that line

Judgments will depend on state. And, in most states (perhaps all?) a creditor can have a judgment renewed by the court, thus resetting that clock. This means judgments are indefinite - both in terms of enforcement by the courts, and sticking on your credit report.

Basically, a judgment can be forever until you pay it or otherwise discharge it, if your creditor wants to continue attempting to collect. You are of course correct that it stays on your credit report for up to 10 years (most states I believe use this length of time) from either the date the judgment was entered, or the date it was renewed. If it is not renewed, it will both become noncollectable due to statute of limitations (however, some states allow a creditor to "resurrect" past judgments, iirc), and at that time unreportable by the credit agencies.

Long story short: Don't let anyone get a judgment against you. Even if you pay it that day in court - settle it if you know you cannot win, or if you have a decent chance losing a case you may feel you are in the right on. A paid judgment is nearly as bad as an unpaid one, in terms of the effect it has on your credit score. Also remember judgments mean you get to deal with fun things like wage garnishment, forced asset sales, lien's, etc. If you want to play that game, you better be damned sure you're judgment proof In most states this means not owning a car worth more than a few thousand dollars, no bank accounts, verifiable employment, etc.

The poster about the FDCPA cases has some excellent advice as well. If junk debt a-holes are re-aging your debts on your reports, you just made yourself some money if you start to enforce your rights under federal law. Please do so! They only play these dirty games because it's cheaper to settle the FDCPA claims for the 1 out of 1000 (if even that) folks that sue them. Easy money at the moment, until (if) more people start taking them to court over these practices.

-Phil

There is only one question I have. Did I borrow and commit to pay back? If so, whatever other calculations there are to make pro or con are irrelevant. I honor my commitments, because to not do so would be to succumb to the feeling I am the worst in the world and be an admission to that fact. There is only one thing of any real value in life and it is self-respect. There is only one war and it's against self-hate. Why would I announce to the world I'm a worthless piece of shit for a dollar. I am worth more than all the world. You wouldn't believe my credit score.
