IIRC, I saw that in the court's opinion (the dissent) but I don't find it in the Constitution/Bill of Rights.

The right to a unanimous conviction may be an interpretation of the amendment not outright stated in the amendment. Just like the right to an abortion is not stated in the 4th. And there is no statement guaranteeing a parent can teach their child any language they wish, but those rights apparently come from the first 8 Amendments.
I am just clarifying that I think Craig is wrong when he states that the rights in the Bill of Rights are protected against state usurpation, just a patchwork of them are, and some of the exceptions are strange. The Justices mention that most people thought what Craig thought even back in 1866, when the Bill of Rights did not affect states at all, and it has just gotten more confusing over time.
