I have no drm protected content yet whenever I would try to sync it would say the nano is unformatted and ask me to format it.
anyway I ended up installed windows 7 on the macbook pro and buying a zune hd to replace the nano...
I hope they fix this in the future because apple makes great hardware that I would love to use.

In your situation it was in fact a formatting issue. If you formatted the Nano on OS X, then it could not read or written to in Windows.
Maybe only if it's formatted initially on OS X? I formatted my nano on Windows XP initially, and have since been syncing with my MacBook from work since it has all my most current stuff on it. I didn't have to reformat it or anything. It actually connects to iTunes 9 and shows it's formatted for PC, but still updates my playlists, etc.
I wanted to do the hex edit to my home machine, but iTunes is literally useless. It won't upgrade because it errors out, and it won't let me install a fresh copy because the current one won't uninstall. I tried manually deleting everything, but there are a few folders that will NOT delete. I can rename and move them, (this allowed me to install v.8 awhile back) but now I'm stuck on that version as it still won't upgrade, or do anything. And it's SLOW, so I stopped using it completely. I don't want to reformat my whole machine because of one program.
Now I do everything strictly through my Mac.
