None of which would have you charged for a brake check or lead car cause of a rear end collision.
You are arguing two disjointed points that have nothing to do with each other.
Let's examine the tailgater, let's assume that the guy/gal is a selfish asshole, a speed demon and just wants to exercise his/her car's ability to exceed the speed limit. Right? OK, if there was no one in the left lane, that person would be gone in a second, you wouldn't even remember the car's color after a few seconds. Maybe they'll lose control and end up in a ditch, maybe they'll clip someone and cause an accident. Most importantly, whatever may happen, they are unintended consequences, do we agree? And, hopefully, the police will stop that person before something really bad happens..
And what happens if he gets right up your arse as you are overtaking and something happens whereby you have to brake suddenly?
Tailgating is bad. Don't do it.

Brake Checking someone who's tailgaiting you.
You're taking a situation which is already unsafe, and making it even more unsafe. If you intentionally break check someone and cause an accident that's borderline assault.

Try getting some logic.
I'm never going to get dinged by someone brake checking because I don't drive up peoples arses in fast moving traffic.
I can't avoid people driving up my arse and I'm not in complete control over when I'll need to brake.
So for me, someone who is following the rules of the road, tailgating is way more dangerous.

I would agree, if they are just blocking the left lane.
However, the law will not go in favor of the tailgater in the case of an accident, for all the reasons WelshBloke stated.
I even have chewed out the wife here and there in the past when she drove like that blocking the left lane, I think I have broken her of the habit.
Not even close. Many people are taught if you do not believe you are able to speed up to change lanes you can brake and change lanes.

Logically it is akin to telling someone to get out of your face when too close. If they freak out when it happens it is their fault.

Brake checking someone who is tailgating you is making an unsafe situation remarkably worse. It's the opposite of avoiding an accident. It's inviting one.
How is it not close. It is a benign signal that you are intending to slow down. (which is my right by law and logic) If you are invading my space I have every right to signal a response. If you freak out, that's on you. If I beat the shit out of you, that's a different story. A brake check is not like a punch, it's like saying get the fuck away from me.
