Take Trumps Advice: Get a Prenup

Talked to a guy this Friday who had just gone through a messy divorce. He had no prenup and is in financial hell. His house is going to foreclosure in three weeks. This isn't a millionaire I'm talking about, he's an independent contractor making ~$50,000/year.

His divorce ravaged his savings. He did get to keep his house however the wife took all his money to compensate for the 'lost equity'.

The worst part is the child support payments. He has to pay his wife $800/mo so that she can take care of the kids on the weekends! She uses that money for her own benifit while he takes care of them.

$800 a month is $9600 per year. He was in great shape before this, he didn't abuse credit cards or any consumer debt. Now he's in foreclosure.

Guys if you aren't getting a prenup I wish you the best of luck, you'll need it.

I'm not, and I refuse to. It shows from the beginning that you aren't serious about the marriage, and are planning for divorce before you even marry. The same reason I don't support individual bank accounts. It harbors distrust and separateness not only with money, but throughout the marriage.

I don't understand why the American legal system works like this. In Taiwan, divorce and it's over. How about hiring a lawyer just to see whose property is whose instead of suing the crap out of the ex-husband?

Child support is different entirely though (at least to me). Mostly because my father's child support (all of which went into savings) is paying for my college education.

Thanks for the spelling correction, don't I look smart .

And Jumpem I respect your view point, but getting a prenup doesn't show a lack of commitment/love. If your plan is to stay together for the rest of your lives then there is no difference between having and not having a prenup.

Fiance> Why should we have a prenup if we are truely in love!
Smart Guy> If we are truely in love we won't need it!

From a purely practical concern you need to have an individual account. Jointly-held accounts can have weird things happen to them if one of the holders passes on since any major activity will require both signatures. You should each have a small individual account (and an individual credit card) to use if something happens and you need to get the other straightened out.
