The amusing/pathetic thing is that the interpretation of the constitution that Cruz & his supporters use to say he qualifies for the presidency would also mean that even if Obama were born in Kenya (he wasn't), he'd fall into the same category since his Mother was a natural born American.

Thus pointing out the obvious racism behind the birther movement.

My son was born in Indonesia and has a US Citizen Born Abroad birth certificate issued by the US Consulate Generals office in Surabaya, East Java. Per the law he would be considered a natural born citizen and eligible to run for President.

Though the Constitution is vague in what constitutes a natural-born citizen, Congress has stepped in to attempt to fill in the gap. Under Title 8 of the U.S. Code, Section 1401 defines the following as citizens of the United States upon birth… or natural-born citizens:

  • Anyone born inside the United States. The person must be “subject to the jurisdiction” of the United States. (This would exempt the child of a diplomat, for example, from this provision.)
  • Any Indian or Eskimo born in the United States, provided being a citizen of the U.S. does not impair the person’s status as a citizen of the tribe
  • Anyone born outside the United States, both of whose parents are citizens of the U.S., as long as one parent has lived in the U.S.
  • Anyone born outside the United States, if one parent is a citizen and lived in the U.S. for at least one year and the other parent is a U.S. national
  • Anyone born in a U.S. possession, if one parent is a citizen and lived in the U.S. for at least one year
  • Anyone found in the U.S. under the age of five, whose parentage cannot be determined, as long as proof of non-citizenship is not provided by age 21
  • Anyone born outside the United States, if one parent is an alien and as long as the other parent is a citizen of the U.S. who lived in the U.S. for at least five years (with military and diplomatic service included in this time)

You might want to quote the relevant law from the US Code.

The intent of that law is for Presidents to be born and raised in the United States... for purposes of loyalty. Of all the recent candidates, Obama's origin and childhood sticks out the most.

If he was qualified, then these other challenges should be immaterial by comparison. That's common sense, but our legal system is a pathetic tarnishment of what's right by reason and instead consists of twisted logic to be taken advantage of by the maleficent among us.

Do any of these men hold a greater loyalty to another country? No.
Do we have any reason to believe otherwise? No...

The article below is from the perspective of how states are handling their votes right now. Many are attempting to make changes to their process so the advantage could swing either way by election time. One thing is certain, it's going to swing.

It's certainly possible that it will be a Republican, but the odds are definitely less than 50%. There are fairly significant structural impediments for them in the electoral college.

It's the same way for Democrats in the House. (actually probably a bit worse for Democrats in the House) The field is systemically biased against them, so you're going to need a party that significantly outperforms in order to get over the hump.

Although predicting elections this far out is a fools errand, considering the structural advantages the Democrats have and the weakness of the GOP field, I'd give Republicans maybe a 1 in 3 shot to win.

I dislike John McSame...refused to vote for him...BUT, I understand that, due to his father's service in Panama while in the US military, he's a natural born citizen.
Ted Cruz is different. IMO, a citizen, but NOT a natural born citizen.

Not sure what you're trying to say, but I tend to think that type of definition fails the Constitutional requirement.

The Constitution authorizes Congress to determine naturalization procedures. It does not authorize them to decide what "natural born citizen" is. Seems to me the type of law you quote above can NOT be used to defines NBC if only because it changes from time to time and Congress cannot change the Constitution by passing a law.

I.e., that type of law falls under Congress's authority wrt naturalization and naturalization means not natural born.

Nope. Hypothetically if he were born in Kenya his mother wouldn't have met the US residency test in effect at that time for him to automatically receive US citizenship.

If born abroad you're not automatically a US citizen because one of your parents is. There are other requirements that must be met.

Nobody here seems to be an expert on immigration and so I am awarding thread win to those who have linked those who are. It seems clear that the research so far indicates he IS a natural born citizen.

Of course the only way a republican wins the next election is if the democratic nominee falls on their face at the 11th hour via health issue or scandal. The republicans are continuing to prove that they absolutely do not understand modern American and appear likely to nominate another non electable person.
