Teen Sues Over Confederate Flag Dress
She Was Kicked Out of Prom for Wearing Homemade Stars and Bars Dress

LEXINGTON, Ky. (Dec. 22) -- A teenager is suing her school district for barring her from the prom last spring because she was wearing a dress styled as a large Confederate battle flag.

The lawsuit filed Monday in U.S. District Court claims the Greenup County district and administrators violated Jacqueline Duty's First Amendment right to free speech and her right to celebrate her heritage at predominantly white Russell High School's prom May 1. She also is suing for defamation, false imprisonment and assault.

"Her only dance for her senior prom was on the sidewalk to a song playing on the radio," said her lawyer, Earl-Ray Neal.

Duty, 19, is seeking actual and punitive damages in excess of $50,000.

She said she worked on the design for the dress for four years, though she acknowledged that some might find the Confederate flag offensive.

"Everyone has their own opinion. But that's not mine," she told reporters outside the courthouse. "I'm proud of where I came from and my background."

Duty, now a college student, said school officials told her before the prom not to wear the dress, but she didn't have another one and decided to see if administrators would change their minds.

According to her lawsuit, she was met outside by two police officers and principal Sean Howard. She said the principal intimidated her by striking the vehicle she was in.

School offices were closed Wednesday. Superintendent Ronnie Back did not immediately respond to a call to his home seeking comment.

The Sons of Confederate Veterans has promised to help pay some of her legal expenses.

 

She should've been able to wear whatever she wanted. The whole idea of the First Amendment is that her speech might not be popular, but she's got a right to embarass herself and her date any way she wants.

Schools have rules that often violate the first amendment. Or should students be able to say anything they like in the middle of class?

She knew what she was doing. She knew what would happen, and it sounds like a cry for attention.
I don't care about what she did. It's why she did it that upsets me. She did it to piss people off, not because of her love for her heritage.

I'm sure it'd cause controversy, but (as an administrator) I think I'd allow it just to avoid the media storm that would result if I banned it.

100% wrong. Schools have a right to establish dress codes, the precedent on that is clear.

This was going to be a media storm any way you look at it.

Confederate flag spells racism to me. I just don't understand this bull sh!t of "heritage" crap, heritage is the american flag you terds. That flag only means they wanted to ditch this country and you know what, if your waving the confederate flag then you should leave because they're the type of people who make this country look bad (inbred rednecks). It just so annoying to see the flag waved by these people, if anybody has noticed is that ku klux klan members wave that friggen flag, hum seems like it supports racism to me. They can deny it all they want but their just living in a fantasy world, grow up and ditch that damn flag you stupid rednecks...

I know the school's rights, but if the school had caught wind of her idea beforehand and had promulgated a rule like, "No confederate dress allowed at prom," she may have had a valid discrimination lawsuit on her hands.

It's really a no-win situation.

The message of the dress is not the issue. The school's decision is the issue under discussion.

i thought only private schools can do that. atleast where i grew up they could.

i think they should have let her wear it. actually it is kind of up in the air for me. if a girl was wearing something too revealing to a prom, the admin has the right to kick them out (and i've seen it happen for a short, SHORT dress). while i know its not the same as wearing the confederate flag around your body, either way they are both offensive to people. but then again, it wasn't revealing and it is her freedom of speech. so i am kind of in the middle.

oh, and i definitely would NOT hit it

Can you not see the association between the confederate flag and racism? If I started to wave the nazi flag I'm sure a lot more people would be irritated. I don't see how this is any different, yes I agree it's school to why they didn't allow it but it really gets under my skin when they ACTUALLY expect to be able to wear it in a school.

and for the record, i am from arkansas and no i dont wave a confederate flag around, i think its a cool looking flag but other than that i know nothing about it. i think it has to do with a war that was fought over slavery, am i right or wrong?

Look just 30 years ago and the Dukes of Hazard TV show. Few people equated the flag on their car to racism and the TV show was not boycotted. This "the confederate flag=racism" thing is a NEW idea.

Just because a few racists use something, does not make that thing inherently racist.

i wish people knew abit about civil war history........ the north only freed the slaves because it would hurt the south, not because of any civil rights issues. the whole confederate flag flab is such bs. people are dumb and ignorant
