Bathrooms are the wrong battleground for this topic. Competitive sports, scholarships and other gender based entitlements are where this battle will be fought. The militant feminist and trangender communities have already crossed swords more than once.
As for your example, there is no way to identify this person, until he engages you in conversation and you wonder why a grown man sounds like a pubescent boy. Medical science can do many things but its not always a perfect swap.

Europe is wrong.
Same gender. Different sex assigned at birth, but same gender. And for that? I'm absolutely comfortable. I don't freak out simply because someone doesn't conform to old notions of sexuality. One of my former colleagues was transgender, and is as upstanding as any good friend.
