The situation we have now is simply that every right wing litigant knows that the best legal strategy is to judge shop for single judge or limited judge venues in Texas where you are basically guaranteed a favorable ruling. That favorable ruling will then be appealed to the 5th circuit where you are also nearly guaranteed a favorable ruling. This is why Elon Musk/Twitter is suing that advertisers group in Texas despite neither of them having any connection to the state.
Congress once again needs to step in and not only expand SCOTUS but eliminate judge shopping like this.
