We know that it is not a hardware issue since nVidia only made one version of this chipset, and it has SATAII and only SATAII, we know that it is not a software issue with OS X since the problem persists in Windows. We know that it can run at SATAII speed since the older systems, and everything but the 13 and 15" MBPs have SATAII. We know that if you order it with an SSD, you get SATAII, if you order with a platter drive, you get SATAI.
That means that the problem is in the EFI firmware on the system.
There is no way that Apple is crippling this intentionally for benchmark/performance reasons. A platter notebook drive cannot utilize SATAII anyway (meaning it can't hit those speeds), and only SSDs benefit. There is very little chance that Apple is doing this for battery life reasons.
My best guess is that there is a 'glitch' or something somewhere along the build line. HOWEVER, at this point, we can almost certainly expect to see a firmware update that will re-enable SATAII and the reason given will be that there was a glitch. Because now the intarwebs have gotten hold of it, and are calling Apple and trying to see what is going on, and to cover their ass they will say it was a glitch and push out a fix regardless of the real reason.
