Greetings Users I got SCREWED,

A few months ago I went into this Ebay business with my friend in which we worked for this guy who owned a warehouse in which he sold pallets of return and overstock merchandise. The man who owns the warehouse is a legit business he also owns another two to three businesses. Our main job was to break down these pallets and sold the items on ebay. For a few weeks the business was pretty good but than the warehouse man never paid us. There was about 5 to 6 thousand dollars that went into his paypal account. His excuse due to the way we sold the items because they were from two pallets and one Xbox pallet (half were good) he could not totally account for the total profit. I came up with an estimated of what he owed (profit) us just for the first three to four weeks of our revenues he did not paid us. That is when I left because I found a job that paid a lot of money in which I worked like 60 to 70 hours a week.

Now I am left with problems of how I am going to get money from this warehouse man. He owed us money I still have the books for the first 5 weeks and the warehouse key. The agreement from the first day I started Warehouse man Vs My friend and I were 50/50, which means the warehouse man made 50% of the profits, my friend 25% of the profits, and I, 25% of the profits. I thought that was pretty good since we did not invested the profit sharing is good.

Now I am thinking because we didn?t have a written contract in the beginning or have one at all that I am pretty much SCREWED alone with my friend. He basically refuses to pay us in so many words because his excuse ?we can not truly account for the profits.? I am like f**K that just give me some money so I can walk away feeling that I did not waste about four weeks on this activity.

I was thinking of what I would offer this guy. Please give me Ideas because anything would be much appreciated. First requirement the only compensation I can receive is cash, no ifs or butts.
1) Warehouse man wants the books and my key because he is a paranoid man who has been audited before by the IRS and he was fined heavily. I am going to offer the only way he can have these things is if he gives me $500 plain and simple. From 5 to 6 thousand worth of revenue my friend and I should at least of made $1000 over the course of the time, that is what would have been expected.
2) If the warehouse man can not give me money I was going to threaten to talk to his friend the Bank President Friend that he could never be trusted with a loan again because he runs a bad shady illegal business to totally ruin his reputation. This also includes other banks in the area.
3) If the warehouse man can not give me the money I was going to threaten to tell his wife that he has been cheating on her.
4) I was also thinking about talking to his wife how much money he has screwed my friend and I out of.
5) I was going to threaten to ruin his PR in the community but in today?s world people are pretty desensitized.

Conclusion, I just need to figure out a way to be fairly compensated for around $500 a person which translates to $1000 for me and my friend. My friend worked for about three months for that guy on this Ebay selling project so I am not sure how much he generated in revenue. I can surely tell you for a lot of items we sold were around $30 dollars. I know for a fact he is trying to rip us out of my friends and my money. His excuses are total bull.

Please, Please, if you guys have any ideas Please HELP!! I need some ideas on how I can retrieve my money?.

This dude sounds very shifty. Even if you could get a judgement against him, you would probably have a tough time collecting.

Yes you did. Basically whatever you argue it will be your word against his. Unless you have irrefutable proof that you had actually worked for him, and no, your friend's word doesn't count. Read on.

Do NOT do any of these things. What you are considering he can turn around and claim you are harassing and either blackmailing and/or extorting him (#1, 3 and 4). This means likely YOU will go to jail and not see a dime in the process. #2 and #5 are also called libel, which is illegal.

Simply keep the books, and the key in a lockbox somewhere and tell noone about it. In fact, you yourself know nothing about it. Karma will come around and get this guy eventually - especially with an anonymous tip to the IRS.

Plain and simple, if you do ANY of your planned options, you can easily go to jail.

I was thinking about appealing to his wife as many times until the warehouse man pays me and my friend. Since We know his wife.

Welcome to the business world. Sad to say this guy is becoming the norm. Don't do anything that can get you sued. Just take him to small claims court.

Agreed. Don't shoot yourself in the foot.

If you have decent documentation of the work you did and the items he sold on eBay as a result, you may be able to uphold your verbal contract in court.

if you still ahve access to the ebay account, print off invoices for the sales, as well as emails if you have access to those, this will be some written evidenceethat your were working with him on ebay.

As others have stated.

Document everything in triplicate.
Get invoices, listings, e-mails, etc.
File in small claims court.

When the case comes up, make sure that you also have the information about other business that he operates and possibly assets that the owner has.

He could just declare a bankrupcy on the business, leavingy ou having to fight that system. By having evidence of personal wealth and the fact that there is no written contact between you and the business, he personaly could become liable for the judgement as well as the business.
