Can theoatmeal get in trouble for starting the downfall of FJ? I mean his post is causing major damage. I wonder if the legal system would find him monetarily liable for this. I hope not, but these days, you just never know.

Which is funny because FJ did that exact thing to The Oatmeal during the first incident. They sent an email to all of their users saying that The Oatmeal was trying to sue funnyjunk and shut them down, then they told them to spam The Oatmeal comments and facebook.

It looks like the lawyer plans to double-down.

In his 20 years as a lawyer, he says, he’s written hundreds of letters like the one he sent Inman, but the response to this one was unique.

“So someone takes one of my letters and takes it apart. That doesn’t mean you can just declare netwar, that doesn’t mean you can encourage people to hack my website, to brute force my WordPress installation so I have to change my password. You can’t encourage people to violate my trademark and violate my twitter name and associate me with incompetence with stupidity, and douchebaggery,” he says. “And if that’s where the world is going I will fight with every ounce of force in this 5’11 18- pound frame against it. I’ve got the energy, and I’ve got the time.”

It’s a bold notion, saying that you’ve got as much time and energy as the internet.

He compares Inman’s charity campaign to when people would sell tickets to throw balls at women being accused of witches in a dunking tank. Money for charity is raised, of course, but the witches aren’t in on it. He may have a very difficult time proving that Inman “instigated attacks,” as he said on his website, but he’s certain he can find some legal recourse for what’s going on right now – “California code is just so long, but there’s something in there about this,” he says.

Pretty sure Inman hasn't done or encouraged ANY of that. Well, maybe just the very last part, but this idiot invited it upon himself.

I wonder if Carreon realizes the irony in his profession and the apparent pronunciation of his last name...

The sad reality of our legal system is that this admittedly awesome rebuttal does not matter. If funnyjunk wants to drag theoatmeal through court, it can. Granted I don't think funnyjunk stands a chance in court. They were just trying to scare Inman and get some money.

Indeed. And, based on his statement, Oatmeal has an opening now to sue for defamation as the attorney said that Inman "did or encouraged" those things. Given that he is an attorney he is held to a higher standard and it would be doubtful that he could couch his unequivocable statement as an "opinion".

Here's what I would do if this went to trial and I were a Judge.

"So, you stole all of Mr Inman's content for your own personal gain and are now suing him for 20k? Instead, you will pay Mr Inman $50,000 for profiting off his work without his consent. If you do not pay, your site will be shut down and become property of the US government, and you will do Jail time."

Ooooh if only! Only in fantasy land though.

This lawyer doesn't sound too bright. It's not that he was trying to bully someone into a settlement based on empty threats and got caught because that happens all the time. His mistake was that he ignored the old axiom about not picking fights with people that buy ink by the barrel. Now, hes not only doubling down, but he's making himself look professionally incompetent by making these dumb statements.

Is he really that stupid? He's somehow crossing the act of witch dunking/drowning with a f%$#ing carnival game.
