Not only is truth an absolute defense, you can say "I think Mr. Carreon is a dirtbag and the epitome of the ambulance chaser stereotype" and you'd be ok since you're exercising your first amendment rights to proffer an opinion as opposed to a statement couched as factual.

LOVE MEEEE!” He described it as a “drawing of your mom seducing a Kodiak bear.” A true
copy of the webpage is attached as Exhibit A.

I can't imagine what his endgame is here. Whatever happens he's going to be known as the asshole who tried to bully an Internet comic and sued the American Cancer Society. From his lawsuit it looks like his hope is that people will be so offended by The Oatmeal that they won't realize there's no merit to the suit.

This crap sucks for Inman to have to go through, but it is hilarious.

I read the letter that Inman's attorney sent to Carreon. This is the best part:

"Not only are FunnyJunk’s claims meritless, FunnyJunk will surely lose in the court of public opinion and cause itself reputational harm. We are also deeply skeptical that a nameless, faceless, business that hosts third party content will be able to demonstrate much if anything by way of damages as a result of The Oatmeal’s allegedly defamatory statements. At the end of the day, a lawsuit against TheOatmeal in this situation is just a really bad idea."

He should launch a new campaign: He should get his fans to pay the dude in pennies.

1. Find out the max number of pennies you can send in an envelope and have it be mailed with 1 stamp.
2. Figure out how many such envelopes need to be sent in order to pay the guy $20k
3. Get people on the internet to send the dude like 100k envelopes of pennies

Legal conventions state that corporations cannot be defamed. They exist in a sort of legal grey zone. Technically they can sue for libel but exact damages are very difficult to prove. It also introduces a host of consequences. Anyone that says anything negative about a company could be held libel. That includes advertisers, activists, unions, and product reviewers. This is why it's not done. Imagine something similar to patent and copyright trolls on a grander scale, against individuals.

The original FunnyJunk lawsuit was a joke. Interestingly, they haven't commented on it as far as I know. Their lawyer on the other hand seems like he's trying to cash in. A Tort Troll if you will. At the same time, he's being demonized in the media for it. He has no case against Mr Inman. It's like watching a slow motion train wreck. We're all watching this guy's career crash and burn, his reputation ruined through his own doing, over something pretty small potatoes. An important lesson in learning Tompick your battles, and when you should cut your losses.

The funniest thing I've seen so far is the quote from Inman, "It's interesting to watch a man with his dick in a hornet's nest try to solve the problem by tossing his balls in as well."
