this si the exact same scenario as that poor guy in the hallway. If the cops ever come to my house I am calling 911. I am telling them that I will unlock my door and lay on the ground with my arms out but that I will not obey commands by police who will shoot me if I make 1 wrong move.

I'm not defending the actions of cops, I'm just pointing out that your plan has a fatal flaw.

The law is rather clear his action was a felony, so I don't see why on earth you think he would get a misdemeanor charge.Sadly under existing law there might not be a whole lot that they can charge him with, he may very well get off with a misdemeanor charge. Since they haven't released the charges, at least not that I have found, they may be digging deep into the books to find something else to charge him with. This is one circumstance where I am all for them charging this asshole with everything under the sun. I wonder, if they can charge him with a felony can they also charge him with felony murder?
