So a few weeks ago I bouth the Optoma HD70 projector online then picked it up at the store.

Last week the item was 100$ cheaper and had a free screen, so I went to the store and they changed my receipt date so I could receive the rebate.

Friday I cam home from work and I had a FedEx delivery wating...a second HD70 projector. (Note I did not sign for it). I scanned my credit card statements and did not find a second charge. I felt the right thing to do was call the 800 circuit city number...

What a bunch of idiots. Took me nearly 30 minutes to get to someone who could make sense of what I was telling them...."You sent me a second projector I did not pay for" Their response was to "take it to the store." Well, I explained to them that the nearest store was 30 min away and I was not going to do that. However, you can arragne for FedEx to come pick it back up....You have my phone number so let me know when you schedule the pickup. This still didnt get through to the customer service....they left it that I still need to take it back to the store?

Haha to sum it up I tried to do the right thing here and they were pretty rude about it.

It's their error. I wouldn't think you would have to go out of your way to fix it. Hopefully you'll get to keep it.

Keep it.

Most stores act the same way when you tell them that you received something you didn't pay for. It's easier to keep it. If they finally do charge your credit card, return it.

Well, you've tried. There's no reason to further exert yourself, so I think you've earned yourself a new projector.

If they aren't willing to send a FedEx driver out your way to pick the item back up, and instead are requesting that you drive 30 minutes to the closest store, I'd say scr3w it, at least you tried. But I'm in a particularly lazy mood today.

At least you were honest about it. Now it's up to them how they want to retrieve their item. I would take down notes (who you spoke to, when) just in case they decide to go after you.

Its not your responsability to drive to the store OR pay for shipping. If they cant make better arrangements, then keep it.

How about I arrange to have Fedex pick it up from you and have it delivered to me so that I can return it to the store for you and get back my shipping fees.

Yeah, definitely, with gas at >$3 a gallon, let THEM fix the mistake! UPS delivered a new 19" LCD of mine, last week, to a local computer repair shop, instead of me. Luckily for me, the folks there were honest enough (like the OP here) to call me, and let me know what happened. I told them to hold onto it, I was going to call UPS, and have them pick it up. The next day, it was delivered to the right address.

Oh, and to make it even better, they're going to refund my 3-day shipping charge of $14 that I paid Newegg to ship it here!

That was nice of them to change your receipt date so you could get free stuff.

The rules are different for USPS from private carriers. If you receive merchandise through USPS, it's yours and you have no obligation to do anything. If you receive things from private carriers, they *could* sue you, etc., but they are probably too incompetent to figure anything out in this case.

There is a federal law that allows you to keep something if you did not order it.
I forget the link, but it is documented on a .gov website.

My friend received an extra Dell 22" LCD. He sold it for 600.

Do you have anything to back that up?

I think the only difference is if they tried the send free stuff via USPS and then billed for it would fall under the Postal inspectors jurisdiction because it is mail fraud. Otherwise it would just be regular fraud.
